We all know there is no such thing as “backsies” in the world of law. Kavanaugh is carrying on about a particular phrase used to describe him and what he does. If he hadn’t been such a pushover, following the leader of Trump, maybe it wouldn’t have happened. We’re stuck with him because Trump managed to railroad his appointment through before his first term ended, and Supreme Court positions are for life. With appreciation to Raw Story:

A recent opinion by Supreme Court Justice Brett Kavanaugh, which has all of the appearances that he wants the expression “Kavanaugh stops” to fade into obscurity, was panned by Slate legal analysts Dahlia Lithwick and Mark Joseph Stern on Tuesday. At issue was Kavanaugh, appointed to the nation’s highest court by Donald Trump in 2018 despite concerns about his past, concurring on a ruling banning the use of National Guard in Chicago, where he clarified, or “walked back” as Lithwick and Stern accused, his stance on which law enforcement stops pass constitutional muster.

Heh. Remember, no such thing as “backsies”, Brett. You brought this on yourself. Apparently, he thinks everyone in our country is an idiot, and we ignore what the Supreme Court does. Nothing could be further from the truth. We notice. And then we count on the sane people in the legal world to break it down for us. There’s no reason to complain about learning now, is there? We will never need to *stop* learning. The more information we have, the more we learn and grow, building an arsenal of knowledge.

In a much-criticized opinion in September, the justice supported the Trump administration’s campaign of randomly stopping Hispanics on the street in an effort to root out undocumented immigrants. At the time he wrote, “Immigration stops based on reasonable suspicion of illegal presence have been an important component of U.S. immigration enforcement for decades,” before allowing that “apparent ethnicity” could be a “relevant factor” for demand of proof of citizenship. He also suggested that any questioning is “typically brief” and U.S. citizens and legal residents would “promptly go free.” That opinion gave rise to what is now called a “Kavanaugh stop” — coined by Drexel Kline School of Law Professor Anil Kalhan.

The slot machine spins and comes up lemons. What a bunch of hooey. Stopping people based on the color of their skin. If that isn’t profiling, then we are monkeys’ uncles. That’s just a petty excuse for ICE to terrorize people and communities. We’ve already seen far too many occurrences of ICE beating people up anywhere and everywhere. ICE likes the brutality and the anonymity. It’s open season on anyone who isn’t white. Remember that pseudo-military-like drop-in when they dragged out the people from every apartment in a building, including children without clothes? That’s ICE for you. And Kavanaugh supported it with his September opinion.

“I think he is begging us to please cease and desist calling them ‘Kavanaugh stops.’ This footnote is buried in the opinion and doesn’t really have anything to do with it. He just says: By the way, this conflict is about immigration stops,” Stern offered. “Wow! Immigration stops can’t be based on race? What a concept!” Lithwick sarcastically added. “A concept that you, Brett Kavanaugh, rejected just a few months ago, in September, in the Vasquez Perdomo case. “I think he is trying to rid ‘Kavanaugh stops‘ from the discourse, which is never going to happen. And maybe he’s trying to send a message to the Trump administration to cool it down,” Stern suggested before pointing out that CBP Chief Greg Bovino pounced on the September opinion to ramp up grabbing anyone with brown skin off the streets with Kavanaugh’s legal blessing.

Stern then added, “Every intelligent observer understood what was going to happen when his opinion dropped in September. Now he seems to regret it—though he still hasn’t apologized directly or acknowledged that he was wrong, and is pretending that what he said earlier is consonant with what he’s saying now. Too little, too late.”

Bovino is one piece of work. I haven’t checked in lately, but last we knew, he was facing some legal troubles for disobeying a judge’s direct order. But Kavanaugh is never going to live that phrase down. “Kavanaugh stops” when he has second thoughts about something months later. Too bad for him. Effing up, then “trying” to reverse it a few months later, is just opening him to more mockery every time he does so, because apparently his pseudo-brain works in slow motion. Too bad, so sad. Think about what you’re saying, you idiot!

  1. “any questioning is “typically brief” and U.S. citizens and legal residents would “promptly go free.” AS IF! Somehow this is not reality. US citizens do not seem to promptly go free. The agents in question simply say their ID is fake and haul them in anyway.
