Now, we all know how much I appreciate this judge because he *knows* the law and he doesn’t pull any punches. We may not have heard from him in a while, but he’s still about. Remember that case from last month that ended up in his lap? The one about flying out “criminals” in the middle of the night? The one where he told them to stop the planes and they didn’t, with some bullsh!t reason? Well. That’s still going on. Just because it’s been out of the public eye for a bit doesn’t mean it’s not still in progress.

Turns out the lawyers are still trying to yank his chain, and It Is Not Working! From MSNBC: “U.S. District Judge James Boasberg said probable cause exists to find the Trump administration in contempt for violating his order over deportation flights last month, explaining that he didn’t reach that conclusion lightly but that officials failed to provide satisfactory answers to explain their actions.” WHAM. He told them from the get-go that he knows what he’s doing, and their lame explanations are not answers. This has been going on for weeks, and he has run out of patience.

“The Constitution does not tolerate willful disobedience of judicial orders — especially by officials of a coordinate branch who have sworn an oath to uphold it,” Boasberg wrote in a lengthy opinion Wednesday. The judge said he would give the government the chance to remedy its contempt, but if it doesn’t, he’ll proceed to identify the people in contempt and refer the matter for prosecution. Ouch! He has told them multiple times he wants *answers* and answers he will get!

Let me add another quote that makes this even better. Again from MSNBC: “Notably, contempt is unique in that judges can appoint lawyers to prosecute it if the Justice Department declines, as one imagines could be the case if Boasberg ultimately refers any Trump officials for contempt prosecutions to the Trump DOJ.” H0, H0, H0.

Judge Boasberg has given them until April 23 to provide the information and documentation he has been requesting for weeks now. The government will have the opportunity to “purge” the contempt by obeying the order they violated. To translate, “give me the information, or I will proceed with the contempt charges.” That seems pretty damn direct to me but I’m not a shady government lawyer, either. This goes back to the first piece I wrote when the Judge first showed up in the news. *WHAT* are they trying to hide that they’ve continued evading the answer for so long? You know and I know the order was violated, but we don’t know *why*. I’m beginning to wonder if we’ll ever actually find out. Will we know, or will we watch contempt proceedings?

One more (last) thing that makes this even better: (once more from MSNBC) “Boasberg’s ruling comes as another judge warned of possible contempt proceedings in the separate high-profile case of Kilmar Abrego Garcia, whom the government also sent to El Salvador without due process and is fighting against his return despite admitting he should not have been deported to that country.”

We have strike one and strike two. Will there be a strike three? Seems to me the Feds are trying to play fast and loose with *everything* in the situation of the people now stuck in CECOT. I guess “suspicion” of Tren de Aragua affiliation is good enough to fly people out in the middle of the night. Let’s see what happens on April 23. Don’t touch that dial.

  1. The problem is this is Federal Court so “You get a pardon! And YOU get a pardon! …”. SCOTUS needs to weigh in and turn off the pardon power of the President. What? That’s unconstitutional? So is what this administration is doing. Until they resign, keep the perpetrators in jail for contempt and ignore all pardons for them.

    • That ruling from SCOTUS didn’t say what Trump, his minions and apparently you say it did. They essentially ruled AGAINST Trump and simply ordered the District judge to clarify the order. However they left open legal challenges to what this administration has done and intends to continue doing.

    • Uh, Sue: The Supreme Court ruling you refer to went 9-0 AGAINST Trump. Judge Boasberg is proceeding according to that unanimous Supreme Court ruling. He does not have the power to do otherwise. The fact that Trump and Stephen Miller lied about the SCOTUS decision doesn’t change the decision. You might even want to read it. Have a nice day.

  2. Springtime for Hitler lite in America. Someone wrote they are trying to bring us Germany in 1939. We need to bring THEM France in 1789. The last ruling royal couple ended up with their heads in baskets. I guess the peasants finally had enough. I wonder where WE are?

  3. I had originally thought they were fighting the return of Abrego Garcia because they didn’t want him talking to the press about what he experienced, but I have heard another theory that the tRump administration is testing whether they can blow past the subprime court on deportations.
    Kind of like a toddler will push their parents to see how much they can get away with.
