The Justice Department is about to FAFO. Judge Boasberg has given them one more day to provide the information requested for the deportation flights of last week. They think they don’t have to provide them because “the government feels he overstepped his authority when he sought to halt deportations of individuals under the Aliens Enemies Act”. Uhm. That act shouldn’t have been invoked at all. It has only been used in times of war. But tRump pulled this thing out of his ass to use an excuse to send people to El Salvador’s worst, horrifying prison. And we are paying for this! We are paying a LOT for this. Overstepped his authority? Please.
Agent Orange’s plans to deport illegal immigrants aren’t going too well. The number of people swept up in this, including those who are here legitimately, is below even Biden’s numbers. ICE has only done sweeps in a few cities. He hasn’t touched most of the land of the US. This isn’t looking too good. Notice how much illegal immigrants’ information has dropped out of the news? It’s been very quiet about this except for the “gang members” who were flown out last week.
Chief Justice Roberts stated flat out that impeaching Judge Boasberg is not the job of the executive branch. It’s done through Congress and there have to be damn good reasons and damn good evidence to even get the process started. The judge has been on the Foreign Intelligence Surveillance Court. He *knows* what he is talking about. ALL judges do! And just because the Mango Mandarin got his feelings hurt is nowhere near a reason to start the process.
Oh, here’s the information he used from Chief Justice Robers: “As the Supreme Court has made crystal clear, the proper recourse for a party subject to an injunction it believes is legally flawed — and is indeed later shown to be so flawed — is appellate review, not disobedience,” the judge said. Again, that’s very clear and you really can’t read much into it, or try to wiggle around it.
He has told the JD to provide the court with information about deportations the Trump administration carried out last weekend under the Alien Enemies Act, or decide if it will invoke “state-secrets privilege” to avoid divulging the information. “The Court seeks the factual information at issue in order to determine whether the Government complied with the (temporary restraining orders). Whether those TROs were legally defective or legally sound does not govern the compliance inquiry,” he wrote.
But Boasberg said he was “unsure at this time how compliance (with his order for the information) would jeopardize state secrets.” If the DOJ decides to invoke the privilege, the judge wrote in a 4-page order, he “is obligated to ‘determine whether the circumstances are appropriate for the claim of privilege.’”
Maybe it’s me but I think he’s being far too nice. He is treading carefully due to our insane executive branch, likely yes, But the law is the law and a judge knows the law and cannot be ignored. Now sure, there’s not exactly much he can do to them about this. But all they have to do is provide the information. That’s really straightforward. It makes me wonder why the Justice Department is fighting this so hard.
This is getting very interesting. I wonder what will happen tomorrow. Guess we’ll just have to wait and see.

You should have used another phrase other than “Trump thought”. It’s fake news. He’s incapable of cogent thought. The evidence has slapped us around for a phucking decade.
The most important fact is that there has been no due process. If, and I say this onluy foer the sake of argument, impeachment charges were formally brought, there would have to be evidence presented as to what the situation really was. The Trumpists are not going to do this. The reason they did it like this is that they have no evidence. Some of these people may be gang members, I have no idea, but if they are they have to prove it, and even then they have to prove they actually broke the law. There has been nothing. That’s the basis of the judge’s ruling, and Trump, as always, is just blowing hot air and making lots of loud noises with his pie hole. We need to be vigilant, but let’s not get too excited, these guys are clowns and they always try to make the courts into a circus. They won’t succeed, most of our federal judges are highly capable.
I like your optimism with the final sentence; unfortunately, there are far too many federal judges who are barely competent (*cough*AileenCannon*cough*) or are utterly partisan (such as that guy in Texas who’s a favorite of right-wing court shoppers). And a fair number of them have lucked out in getting some of the cases have allowed the Drumpf Administration to keep destroying people’s lives.
DHS does not have to prove if any of these scumbags are gang members. They were ALL in the country illegally. That’s enough. Deport them all.
If DHS is going to CLAIM they’re gang members then they DO have to prove it, especially when they’re using the CLAIM as the REASON for the deportation. If you bothered to actually read reputable news sources, you’d know that.
And, for the record, EVERYONE in the US is subject to US laws and rights. I’ll guarantee you that if you went to some foreign country (whether legally or illegally) and you broke a law there, they wouldn’t necessarily deport you until AFTER they put you through their legal system *unless* the US government formally agreed to prosecute you for that crime. So, even if a “gang” member is deported because he’s here illegally, if he has not committed a crime CONNECTED to that gang membership, you can’t just use that as a reason to deport someone.
Additionally, dorkwad, you might want to recall that the “gang” in question is from VENEZUELA but they’re being deported to EL SALVADOR to sit in JAILS at US taxpayer expense.
The reason for deportation is that they were in the country illegally. Period. Yes shit for brains they were sent to El Salvador because of a third country agreement made with our state department for a small fee. MUCH less of a burden on the American taxpayer than keeping these pos criminals alive and in our prison system.
