The Nuremburg defense is what’s going to hang Donald Trump, at least that is the way that Glenn Kirschner sees it. As you have undoubtedly read, certain of Trump’s co-defendants in the Georgia case have been saying that they were acting under Trump’s direct orders and if and when they testify to that and give specific dates and details, that is going to be a momentous day for Trump and for us all. Just imagine a bigggg bus and all Trump’s minions throwing him under it.

This clip is nine minutes long but well worth the listen.

The main guy in Georgia, David Schafer, who claimed to be the “Chairperson” of the fake electors, did exactly what Kirschner is talking about here. He claimed in a court filing that he and the other Republican electors who tried to falsely certify Donald Trump as the winner in Georgia were acting at Trump’s behest. Axios:

Why it matters: As defendants in the sprawling case begin to turn themselves in ahead of the Friday deadline, Shafer’s position signals that some may be poised to turn on the former president.

Flashback: Shafer and 15 other Republican electors met at the state capitol on Dec. 14, 2020 and signed a document falsely declaring that Trump had won Georgia.

  • Trump and several of his former lawyers — along with some of the Republican electors and other alleged conspirators — now face charges relating to their alleged roles in trying to overturn the results.

State of play: “Mr. Shafer and the other Republican Electors in the 2020 election acted at the direction of the incumbent President and other federal officials,” Shafer’s lawyers wrote in the court filing Monday.

  • Attorneys for the President and Mr. Shafer specifically instructed Mr. Shafer, verbally and in writing, that the Republican electors’ meeting and casting their ballots on December 14, 2020 was consistent with counsels’ advice and was necessary to preserve the presidential election contest,” they added.
  • Shafer — like co-defendants Mark Meadows and Jeffrey Clark —is seeking to have his state-level case moved to federal court, where his case would be presided over by a federal judge and have a potentially more sympathetic jury pool.

Shafer in particular is in a real pickle because he made himself out to be the “Chairperson” which any reasonable person could interpret as ringleader, head of, that sort of thing, of the Electoral College of Georgia, and he filed a fake slate of 16 pro-Trump electors in December, 2020, per the New York Times. He’s facing eight charges including false statements  and writings, forgery in the first degree, and impersonating a public officer. He’s in a world of hurt if he doesn’t flip. I predict he will flip. If there’s any other option open to him, I haven’t read it anywhere so far.

Trump.Is.Toast. Burnt toast, in fact.

  1. So, “he ordered me to break the law” is now a defense? Last time I looked, it isn’t but then I’m not a lawyer. If it is, would one of you all hire me and tell me to rob a bank? Seriously man, WTF?

    • it’s A RICO case…..this ties underlings of a greater criminal conspiracy to the decision makers, so all parties involved in the crime can be charged, not just the ones who carried out the act….this same type of case is what allows drug cartels, mafia, gangs, and other criminal enterprises to charged as a whole….

      so yes if you were working for someone and they asked you to rob a bank, they are likely getting a cut of the taking….making both of you criminals….if someone told you to rob the bank, you did, and they had nothing to gain from it….you’re just an idiot bank robber….

      if there is evidence of the POTUS and his staff directing criminal acts of fraud and forgery to change the results of an election….all people involved should be penalized and labeled traitors to the constitution
