We finally celebrate the release of the Jack Smith transcript, as I wrote about yesterday, but someone who knows these sorts of things says something is off. This is a tad unnerving. They finally put the transcript and video out there (and thanks to reader beadecked for watching it and providing the most interesting information), but it seems there is something that’s not quite right. A former federal prosecutor on Wednesday slammed the House GOP for releasing the transcript of former special counsel Jack Smith’s deposition earlier this month over the New Year’s holiday. House Republicans interviewed Smith for several hours this month about his investigation into President Donald Trump’s efforts to overturn the 2020 election. Following the interview, Smith called on Republicans to release the entire transcript. Republicans obliged on Wednesday by releasing the 255-page document and an eight-hour video of the interview. Joyce Vance, author of the “Civil Discourse” newsletter on Substack and law professor at the University of Alabama, reacted to the release on “MS Now Reports.”
Alrighty! Here’s our intro, showing us what’s wrong with this picture. Ms. Vance had quite a few things to say, and we should really actually worry about what’s going on in the background. On the other hand, Jack certainly knows what he’s doing and has done, and he won’t be “used” that easily. The Republicans keep forgetting what else he’s done (read: prosecutor for the ICC), and we can bet that it will surprise them when they should know better. Mr. Smith is no pushover. He’s strong. They are not, especially when faced with the truth.
“Everything about this is odd,” Vance said. “The fact that the witness who wanted to testify publicly wasn’t permitted to. The fact that volume two of his report was not released in time for him to testify about it, and everything about this hearing appeared to be a setup with Jack Smith as the gotcha target for everything that was going on. Anyone who has not learned the lesson of Jim Comey‘s prosecution, I think, needs to take that into account here, that it was, in many ways, an effort to set Smith up.”
Jack is no fall guy; innocent and unaware. Republicans continue to forget that. As we saw yesterday, he is well aware of something they might try to do, and he won’t be taken down like they think he will. Again, remember Mr. Smith’s background. First one: he’s an *experienced* lawyer. Second, a prosecutor for the ICC. Third, he had a case as special counsel that would have put Trump *in jail* had he had time to finish. We can doubt he’ll be taken down, because the GOP doesn’t look beyond the surface.
Republicans repeatedly bashed Smith ahead of his deposition, claiming that his investigation was politically motivated. Smith pushed back forcefully against those assertions during his interview, according to the transcript, and told lawmakers he believes Trump can still be held accountable for his crimes. “The public reason that Republicans gave for not doing this testimony in public was that they thought that Jack Smith would use it as an opportunity to grandstand,” Vance continued. “He did not. Now we have the release of both the video and the transcript. Of course, it’s happening on New Year’s Eve. The hope is that this document, which would have come out at some point, can now be lost in the shuffle of the evening’s festivities.”
No, it’s not going to be lost, not for the smart half of the country. They forget about us and think they’ve covered their arses, and that’s an edge up on things for us. We are intelligent and observant, and we pay attention to the story behind public presentations. We don’t forget, even when the news moves on to something else, that they think they can use. They can’t spin this. Their assumptions will catch up to them and slap them down. We will slap them down. We can’t be stopped. And by gods, midterm elections WILL take place. We are watching.

Not being a lawyer, I hesitate to comment on legal matters. But I suspect A LOT of Republicans, in Congress and elsewhere, have criminal liability for their actions related to the January 6 Insurrection. Jack Smith has the goods on them. Even if they are never tried in a courtroom, the court of public opinion will not be kind to them.
