These people. Sheesh. They don’t want to follow *any* rule of law unless it can be twisted for their use. But if one tries to use the law “against” them, they scream about it and try to slant their words to “boohoo, poor pitiful me”. After the recent debacle with Blondi and Congress, everyone now knows, because it couldn’t be missed, that the DoJ has no J anymore. It’s just Trump’s third arm because they do what Trump tells them to do. It seems, however, that Trump’s fourth arm, that being SCOTUS, has broken off and is actually following the law. Okay, at least once they did, but we can expect that to stop soon. They always do.
But we’ve gotten a tiny bit off topic here. The DoJ had a hissy fit about a new AG being selected for Virginia that *they* didn’t choose. It doesn’t matter what the law says. It only matters what *they* say it does, and when. This is ridiculous. Thank you, CNN and Raw Story:
The Justice Department said Friday that a newly appointed interim U.S. attorney in Virginia was fired just hours after federal judges selected him to lead the influential office, triggering a fresh clash between the judiciary and the Trump administration. According to CNN, judges in the Eastern District of Virginia unanimously appointed veteran defense attorney James Hundley to serve as interim U.S. attorney after Trump loyalist Lindsey Halligan was forced out last month.
There were multiple screwups by Ms. Hooligan during her ‘tenure’. The judges were unhappy with her. She’d never been a prosecutor and had no idea what she was doing. But gee, she was one of the Femme Fatales and looked good, so Trump wanted her. We all remember how many times she embarrassed herself, and don’t forget the flat-out lies and omissions. She wasn’t much fun to write about because she was so pitiful. Mr. Hunley has one helluva resume here.
Shortly after the appointment, Deputy Attorney General Todd Blanche unceremoniously announced in a social media post that the new nominee was out. “Here we go again,” Blanche wrote on Friday. “EDVA judges do not pick our US Attorney. POTUS does. James Hundley, you’re fired!” Not long after, White House deputy chief of staff Dan Scavin, an assistant to the president, added, “Check your email, James.”
What a bunch of hooey. Yes, judges pick the AG until a candidate is approved by Congress. Trump can nominate someone, but they aren’t automatically in the position. Ooo, lookie!
28 U.S.C. § 546, specifically as amended in 2007, authorizes federal district courts to appoint an interim United States Attorney (often colloquially referred to as an “AG” in this context) if a vacancy exists and the Department of Justice-appointed interim attorney’s 120-day term expires before a permanent successor is confirmed by the Senate.
There we go. It happened as was stated. One would think that judges know what can be done when this sort of situation happens. They were well within their rights to choose someone. But we are discussing DoJ rights, and others don’t matter. Good grief.
Hundley did not immediately respond to requests for comment. CNN reported it has reached out to the Justice Department. Halligan’s brief tenure at the Trump Justice Department ended after failed attempts to prosecute the MAGA leader’s political opponents, including former FBI Director James Comey and New York Attorney General Letitia James. A federal judge later ruled Halligan’s appointment invalid, writing that the power to appoint an interim U.S. Attorney rests with the court until a Senate-confirmed nominee is approved, CNN reported.
BOOM. There it is. And the DoJ *knew this*. That must have been quite a slap to Mr. Hunley. He only had hours. It’s almost not worth mentioning to him that the judges obviously thought very highly of him, or he wouldn’t have been chosen. So how many cases are sitting in limbo because there’s no AG? I’m not sure if that’s applicable, but it seems like it would be. And when in the hell is the DoJ going to get someone in there? It’s been weeks. Apparently, they have to go find another Femme Fatale with no brains or morals to add to the collection. This is just stupid. Just stupid.
Friends, I know everyone begs you for money. I promise that among all those asking for spare change, we are the smallest and the hardest-working. We’re a group of old, disabled people, except for one writer in his mid-50s. The rest of us are in our sixties and seventies, and this is a labor of love. All we’re asking for is the chance to keep telling the truth about Trump and help ensure democracy survives. If you can help, please do. Thank you. Ursula

This sorry excuse for an administration is interminable!
I keep telling myself one more day, one more day, trying to get through the years because I would *never* had expected this a year and a half ago. Being jobless isn’t helping,
there are probabky few if any cases sitting in limbo. they don’t seem to be doing anything with non trump instigated cases. at the start of trump 2.0 bondi announced the doj would no longer be persuing financial crimes. i assune that applies to other types of crimes as well.
Hello Bob – thank you for the information. (Obviously) I did not remember that.
