Yup. He should have kept his yap shut. The “border czar” (yea, right) came right out and said what the parameters were for detaining supposed immigrants. It would have been smarter to just tell ICE and not let us know about it. This is going to backfire in a major fashion. I’m not sure who it’s going to hit, Tom, Kristi Gnome, tRump, could be any or a combination of 2 or all 3.

This seems to be a hallmark of the new administration. Things that should have been kept quiet are blurted out, and then there’s some serious “plausible denial” that has to happen, which usually doesn’t work. Take what’s going on with the whole Epstein ridiculousness. Gotta say I am sick and tired of the whole thing. My opinion isn’t something I should share because ooooofffff not a good idea.

But, back to Tom Homan. His mouth is writing checks that he can’t cash. I’ve detested him since day 1, and he is NOT the brightest bulb in the box. Hence, he doesn’t know when to keep his mouth shut. From Raw Story:

President Donald Trump’s hand-picked border czar, Tom Homan, is facing backlash from legal and political experts after asserting that Immigration and Customs Enforcement agents do not need “probable cause” to detain individuals, and can do so based on factors like “personal appearance.”

WHAM. There ya go. I don’t think this is something Agent Orange wants people to know. Of course, he can’t keep his mouth shut either (hello, 2 am Truth Social rants), so he has no room to talk. It would have been better to keep it quiet.

“Look, people need to understand,” Homan told Fox News on Friday. ICE officers “don’t need probable cause to walk up to somebody, briefly detain and question them.” “They just need to tally the circumstances, right?” he claimed. “They just go through their observation, you know, get out typical facts based on the location, the occupation, their physical appearance, their actions.”

“A uniformed border police officer walks up to them, for instance, at a Home Depot. And they got all these facts, plus the person walks away or runs away,” Homan said, offering one scenario. “Agents are trained. What they need to detain somebody temporarily and question them.” “It’s not probable cause,” he insisted. “It’s reasonable suspicion.” “We’re trained on that. Every agent, every six months, gets Fourth Amendment training over and over again,” Homan said.

Suuuuuure they do. Backpedal so he doesn’t sink that ship. Try and make it sound matter-of-fact. But physical appearance? That’s sure as hell racial profiling. We already knew it, but he made it official. And he doesn’t care that US citizens get caught in these sweeps. Oh, you might get let go eventually, but for a few hours, at least, you’ll be incommunicado and NO ONE will know where you are. Here’s a bit more from the article. Legal experts blasted Homan’s remarks. Attorney and California Democratic state Senator Scott Wiener charged, “This is literally the definition of a white nationalist police state.” U.S. Rep. Yvette Clark (D-NY) warned, “Trump’s thugs will racially profile you, then go on national television to brag about getting away with it.” “THEY ARE ADMITTING IT,” wrote David J. Bier, Cato Institute Director of Immigration Studies and an expert on legal immigration, border security, and interior enforcement. “Homan is admitting to participating in a criminal conspiracy against the Constitution of the United States,” he alleged.

Yea, he should have kept his mouth shut. He didn’t. So now, who is going to run damage control? Who is going to try and whitewash his remarks? It’s too late. It’s out there, and they will be catching hell for it for some time to come. Well done, sir. You suck.

  1. Homan might actually want to pay attention the next time they go in for that “Fourth Amendment training” since the Fourth Amendment actually says NOTHING about “reasonable suspicion” but DOES mention “probable cause.” It’s actually a short amendment; here’s the full text:

    “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

    Also, the Fourth kind of talks about WARRANTS that must be clear in “particularly describing the place to be searched, and the persons or things to be seized.” How exactly do you obtain a warrant covering the kinds of actions that ICE has been doing and adhere to the Fourth Amendment? To paraphrase Tom Cruise in “Jerry Maguire”: “Show us the warrants, Homan!”
