A three-judge panel composed mostly of jurists appointed by Donald Trump blocked ongoing criminal contempt hearings as U.S. District Court Judge James Boasberg was considering sanctions after government attorneys violated his order to halt deportations under the Alien Enemies Act. Last year, Boasberg found there was “probable cause” to find the Trump administration in criminal contempt for defying him by sending a Venezuelan man to the CECOT prison in El Salvador.
He had been given permission to continue by a different court. And now he can’t? That irks me, to say the least. They *did* violate his order with nonsense excuses. It wasn’t just one, either. The lamest excuse was that it was a verbal order and not etched in stone. Last I knew, *either one* counts. I won’t get into a specific case again.
In an order on Monday, the panel of three judges — Neomi Rao (Trump), Justin R. Walker (Trump), and J. Michelle Childs (Biden) — ruled that the criminal case could be assigned to a new judge and that Boasberg’s contempt hearing must end. “[T]he district court is directed to terminate its criminal contempt proceedings in this case,” the order said. The Tuesday order also dissolved an administrative stay Boasberg put in place.
Dadgum. It would be nice to know the background for their decision. We can hope that it wasn’t just Trump’s chosen judges killing the case. But it could have been. Either way, we don’t know. If more comes out about this later on, maybe we’ll get the information then. I’m still crabby. This was almost an open-and-shut case. Unfortunately, what’s done is done. I expect this to get buried somewhere and never happen. Damn.
