Hello y’all! You already know I’ve been following this rather closely from the get-go. It all started with Judge Dugan directing a gentleman to exit through the jury door, instead of the “usual” courtroom door. ICE agents were waiting outside to arrest and deport him. *She* was arrested for “charges of helping an undocumented immigrant elude federal authorities”. The jury door was but a few feet from the other door. ICE was slow on the draw and didn’t notice him until the elevator door closed, but they were able to arrest him outside the courthouse after a short chase on foot.
So, here we were with a *judge* being arrested, which gave me screaming fits, as well as being arraigned, which gave me *more* screaming fits. Well, I hope this will be the last column on the subject because she did something *completely* unexpected in return. Are you ready for some legalese? I hope so because here’s what happened. By the way? They actually handcuffed her when she was arrested. I just now noticed when looking at a picture. (Derp!) Good grief!!! You can read the whole reply here.
The action comes even before Dugan has entered a plea, which is expected May 15. Usually, motions come later in a case, but her legal team is arguing that the issues of immunity and federalism need to be resolved immediately.
“Immunity is not a defense to the prosecution to be determined later by a jury or court; it is an absolute bar to the prosecution at the outset,” it said. “The immunity and federalism issues must be resolved swiftly because the government has no basis in law to prosecute her. The prosecution against her is barred.”
The motion goes on to call the prosecution “virtually unprecedented and entirely unconstitutional” and calls problems with the case “legion.” The motion makes two arguments: that Judge Dugan cannot be prosecuted because she is entitled to judicial immunity for her official acts and that prosecutors were exceeding federal authority in the case.
Well. How about that? What she did was protected, and what the Feds did was illegal. I’m hoping that the judge over her case doesn’t mess around anymore and throws the case out. For legalese, that’s pretty damn clear, yes? She is also protected under the 10th Amendment, which “prevents the federal government from trying to expand its powers beyond the powers granted by the Constitution”. It’s time. WHAM, no more case.
Now, I’m not a lawyer, not even close. I get by with what I can look up to add to my information from various websites and, yes, Google searches. It’s all a matter of phrasing when you ask for information. For example, I ran across this: What is Amendment 10 in kid words? Well, that made it simple and clear, so I could quote from it as I’m writing. I will occasionally ask my husband for help as he’s a Search Gawd. Sometimes I just can’t find what I’m certain is out there. There’s no shame in asking for help. Let’s give you a little more of the article to quote, and then I’m going to close, because this isn’t something that supports a 2 or 3-page piece.
In support of the immunity claim, the motion cites a U.S. Supreme Court ruling involving then-former President Donald Trump.
“Judges are entitled to absolute immunity for their judicial acts, without regard to the motive with which those acts are allegedly performed,” the motion says.
In addition to immunity, the motion says the prosecution violates the 10th Amendment to the U.S. Constitution, which covers states’ rights. It argues the charges are a federal overreach.
Overreach, indeed. Kudos to Milwaukee County Judge Hannah Dugan. She deserves them and more. This is going to make federal attorneys look pretty damn bad, and I hope it does! We shall see. If it’s tossed, I’ll tell you folks. Thanks for sticking with me!

Did you stop to think how those millions could be spent to build, oh, I dunno, new prisons in the US which could provide hundreds of thousands of jobs between construction and staffing? By the by, this judge’s immunity has a very good chance of being upheld–and even SCOTUS (which managed to carve out a FALSE immunity claim that served #DrowsyDonnie, the guy who PAINTS HIS FACE ORANGE, very well–even though it had NO legal merit since none of the actions in the case had anything to do with his job as President) is highly unlikely to rule in Drumpf’s favor here because they know (or, I hope even “Uncle Clarence” and Alito can see the inherent danger of ruling in Drumpf’s favor) their own jobs would be at risk if DictatorDonnie (or, more likely one of his cronies/lackeys/asskissers) disapproved of one of their rulings.
