You’ve heard that mice run when the ship starts to sink and now you see that demonstrated before your very eyes. Evan Corcoran, a lawyer to Donald Trump on both the Mar-a-Lago documents case and the January 6 case, has decided to withdraw as counsel from the Mar-a-Lago case, after testifying before a grand jury last month. Evidently the crime-fraud exception to attorney-client privilege is disturbing Mr. Corcoran. Or disturbing someone, fancy that? Washington Post:

Prosecutors investigating Trump’s taking classified documents to his Mar-a-Lago Club after leaving office won a court fight that allowed them to question Corcoran when judges ruled that he could not use attorney-client privilege to avoid disclosing information about his communications with Trump. Prosecutors cited an exception to the legal principle that lawyers must keep confidential what they are told by their clients when there is evidence that a client used the attorney’s legal services in furtherance of a crime. […]

Corcoran played a lead role in communicating with the Justice Department in response to the subpoena and attested to investigators in June that a diligent search had been conducted to collect classified documents. Corcoran was forced to answer questions about Trump and his legal team’s response to the subpoena and regarding the communications he had with Trump about returning the documents, The Post has previously reported. Grand jury proceedings are secret, so it is not immediately clear how helpful Corcoran’s testimony might be to Smith and his team. But legal ethics rules — including those in Maryland and D.C. — generally bar lawyers from acting as advocates at trial when they are likely to be essential witnesses.

It may be that short and that sweet. It would be good to watch what Chris Kise and Todd Blanche do next. They are Trump’s white-shoe law firm folks. Both are highly paid and supposedly received massive retainers up front. Like Corcoran, they will do whatever they can, but they won’t “take a bullet” for Trump, as the Michael Cohen of yore said that he would. And, I am quite sure that they all intend to hang onto their law licenses. Whether Christina Bobb, Alina Habba and that crowd can do so remains to be seen.

  1. Trump is not going to like this, especially if his other high quality lawyers resign. It’s tough getting good legal help, when you flout the law at your every whim.

  3. I wonder if every time another shoe drops like this one, trump goes to his buddies for another pill, (just to sooth the angered beast that wants to throw up in his face) …

    Trump has always maintained a hold on his rage in the moment, like when Obama singed his ego at the roast for the communications people …

    He instantly makes plans to get even, in this case, forever, as he destroyed everything at the CDC that was set up by Obama …

    He absolutely has earned and will continue to resist any responsibility for these situations that require a punishment follow-through … The only thing that makes sense is the fact that ALL the Court systems State AND feds are assembling enough evidence to smite the dragon once and for all …

  4. Corcoran would likely have been charged in connection with those docs. He was involved with the searches, such as they were, and was the one who told what’s-her-name to sign the doc as custodian, even though she had no personal knowledge of them or the search.

  5. Every time Michael Cohen appears in the news it causes heartburn for Bragg and James up in New York. Maybe Willis down in GA and even a bit for Smith himself. But this latest development suggests to me that while Trump will always find third rate and even second rate (sometimes) lawyers to represent him first rate lawyers he’s managed to retain (the kind who can demand and get hefty upfront retainers btw) think about their business with Trump every time Cohen is in the news. They look at Cohen having been convicted and sentenced to prison, as well as having been disbarred. For lying to protect Trump! That’s got to be a sobering thought to them and the handful of first rate lawyers Trump has don’t want ANY part of what happened to Cohen happening to them! So, even if Cohen is reining himself in some in his commentary his popping up regularly is an uncomfortable reminder to some of Trump’s lawyers about what’s out there waiting for them if they cross the line. They know Trump would throw any one of them under the bus in a heartbeat and though I said it recently I’ll say it again – I suspect they are engaging in some major CYA (like Cohen’s instincts caused him to do) but unlike Cohen they will step away from risking the calamities that befell Cohen instead of his mistake of crossing the legal line for Trump.

According to Business Insider, trump posted on Trash Social that he has “more lawyers” working for him “than any human being in the history of our Country, including even the late great gangster, Alphonse Capone!” And this is before his legal fees skyrocket with the expected new indictments. Trump is going to need prison just to keep a roof over his head.

  7. With all of these crooked lawyers, one must wonder what “law schools” actually teach. It does explain why most lawyers would make more money in more productive occupations but also why so many gravitate towards working for organized crime….
