There was a happy smiling woman with Elon Musk today, as they gleefully held a big copy of the check that made her a millionaire. And there was another lucky soul, we are told, who will also receive a check for a million dollars. But cashing them may be a different story. Here’s the idea: Musk paying people to vote is illegal on its face. He originally described his lottery as being a payoff to two people who signed his “Activist Judges” petition and voted. He was later informed that was illegal and now the checks are for being “a spokesperson.” But that may not fly because the people who signed the petition and voted did so with the idea of Musk’s lottery as the payoff. So far as I know, you can’t get paid for something that is illegal on its face and George Conway says this is illegal on its face.
The check looks to be drawn off of a PAC. Let’s see if the PAC is able to make a payment because this matter is now being challenged by the attorney general of Wisconsin. Now I would think that the checks would not get paid if the underlying reason for paying them is something illegal and if the court determines that this entire exercise by Musk is illegal. That’s basic common sense.
But let’s see if these two people become millionaires. I’m sure they’re all giddy and ecstatic but let’s see if the check clears the bank or not. Maybe it will go through. Maybe they’ll be asked to refund the money later, if it turns out that the entire lotto scheme in Wisconsin was illegal as hell and that’s how the court determines the matter. I don’t claim to know how any of this works, because I’ve never seen a case like this before. This will end up in some law book someday though, mark my words. And maybe there will be a whole new area of law, Trump Law, where all the illegal shenanigans being tried now will be written up and explained legally, under one umbrella. I would not be surprised.
