While the shutdown of the government is in the center ring, don’t forget to look at some of the other sideshows, because they are not without amusement. Tina Peters is imploring Pam Bondi and the DOJ to “get off your asses” and get Peters’ ass released from prison. There are a few basic problems with that, however, like jurisdiction, res judicata, all kinds of stuff. And yes, we know that Mike Lindell thinks those things are no biggy but that’s because he fails to grasp that only certain courts can achieve certain things for certain people under certain circumstances. Here we go again, with Civil Procedure For Morons.

I think Pam Bondi should send in the clowns (there have to be clowns) because she can’t send in the marshals — not to release Tina, in any event. It’s intriguing to me that Peters is arguing that the State of Colorado didn’t have the right to indict, prosecute, and imprison her, because they did all three and in a squeaky clean case, too. The facts and the law were on the prosecution’s side. And yes, we know this is Trump world and those things don’t matter to the conspiracy crazies but unfortunately this isn’t Wonderland. You break the laws here, in the real world, and you will end up in some tacky place called a prison. It does work that way. Ask George Santos, he sends regular laments from his place of incarceration. There is that old expression, if you can’t do the time, don’t do the crime.
Peters was convicted on state charges, so it’s not clear what the DOJ could do to secure her release. Colorado Attorney General Phil Weiser (D) in March called the DOJ’s effort to intervene in the case a “grotesque attempt to weaponize the rule of law.”“The United States cites not a single fact to support its baseless allegations that there are any reasonable concerns about Ms. Peters’ prosecution or sentence, or that the prosecution was politically motivated,” Weiser said.
Bottom line, unless the Trump-loving SCOTUS decides to change the law in some mindboggling manner: this is a state case. It is not a federal case. DOJ doesn’t have jurisdiction over it. And neither does the FBI. I mention them because Lauren Boebert got involved, naturally.
After Trump’s return to the White House, Rep. Lauren Boebert (R-Colo.) said she previously sent a formal request to the FBI “to look into the sentencing and treatment of Tina Peters.
So what is the FBI supposed to do, send Kash or Ding Dong Bongino to go bring coco to Tina and tuck her in at night? I fail to see how the FBI has jurisdiction over a settled Colorado case but then I make no claim to having the same legal mind as Lauren Boebert. Nope, that’s nothing you’ll hear me say.
But I do so wish that Peters had acted as her own attorney, because I would have loved to hear her arguments that the State of Colorado has no jurisdiction over the malfeasance of a Colorado county clerk and recorder. Surprise, Tina, they have jurisdiction over the malfeasance of all of them. And I would kill to hear Tina argue that the State of Colorado violated federal election law by locking her up. That would be a pitch for the ages.
You can see where she and Mike Lindell are a match made in heaven. And like Lindell, Tina intends to keep on keepin’ on.
“You know, I’m going to keep speaking out about the injustice, about what’s going on in these big multinational global corporations that have these vote flipping software, that is basically, is in Serbia,” she told Bannon. “We’ve already shown that people in my, that I’m accused of influencing, there’s emails between them and Serbia and Serbia Dominion employees.”
Tina Peters is a glaring testament to the fact that anybody and we mean any body can get into politics nowadays. In fact, the stupider you are, the more it seems to help. But hey, maybe Kash and Ding Dong will listen to Bobo and they’ll fix this. If I was Tina Peters, I wouldn’t hold my breath. We’ve taken giant strides towards becoming a banana republic but we’re still not there yet. On the other hand, it’s only Wednesday and Trump is in office.
Speaking of Trump, it will be interesting if he decides to chime in on this.
