Trump’s expert witness will not be testifying, Carroll’s lawyer Roberta Kaplan just said in court. That leaves the ex-president with no live witnesses on his list,” reports Law & Crime’s Adam Klasfeld. He adds that Trump’s attorney, Joe Tacopina, “confirms: No defense case.”
New York Law Journal’s Jane Wester explains, “Donald Trump will not put on a defense case in the E. Jean Carroll case. He was expected to present a single witness, an expert, but that witness is facing health issues, his lawyer Joe Tacopina says. Carroll is expected to finish up her case tomorrow.”

Defense attorney Joe Tacopina told the judge he had decided not to call an expert witness that had been expected to testify for the defense.
“We’re not going to move forward,” Tacopina told Judge Lewis Kaplan.
Also today, psychologist Lesley Liebowitz shot down the few objections that Trump’s lawyers have raised in order to prove that Donald Trump didn’t rape their client. They were contending that the rape didn’t occur because Carroll continued to shop at Bergdorf Goodman. Liebowitz replied, “She didn’t feel the store raped her.” The other bone of contention was Carroll watching The Apprentice and the reply was that people in her social and professional circles were doing so and if she didn’t she would have had to explain why.
Liebowitz said that Carroll did display signs of PTSD but declined to offer an opinion whether she was raped. Now it will be for the jury to decide. Trump’s going to lose, barring something unexpected happening and I think he’s all out of cards to play. At this point, I frankly don’t know how this is even going to go up on appeal, unless Joe Tacopina’s Monday morning panic motion describing the judge as biased will do it. That opinion is not mine alone, by the way.
Civil rights attorney Andrew C. Laufer says Trump not presenting any witness means he is “throwing in the towel.”
“This is literally Trump throwing in the towel,” Laufer tweeted. “To not even produce his mental health expert witness who examined the plaintiff in order to rebut her claim of damages or give testimony himself sends a terrible message to the jury. Prepare for a plaintiffs verdict. It will be appealed but it doesn’t sound like it will be successful.”
And just an afterthought: if Trump is found liable for rape next week, I wonder how Melania will take it?

I believe that’s probably true. However it doesn’t mean she can’t stand his ugly orange a$$. She’s still married to him but I have no doubt at all that their prenup was renegotiated to ensure she’d eventually get her payout without EVER having to f*ck him again. In addition to his legal troubles and what the NY AG can do to his business (or the feds if Jack Smith wants to play hardball) Trump has some real financial institutions that are sitting on roughly 400 million in money he owes them and the due date is approaching. If I’m not mistaken it will be sometime next spring or summer when he has to fork it over or go into default. If that happens the whole house of cards finally comes a tumbling down and Melania will be at the back of a very long line of creditors. She might wind up with jack if she’s not careful. I have no sympathy for her at all and would enjoy seeing her plastic face crack when her jaw drops open so far at the realization her greed cost her “bigly.” I can just hear her wailing “Vat do you meen there ees no money to pays me for fooking him all theece years?”

I was curious to know what she was seeking in damages. According to a story in the NY Times two days ago,
“Her lawsuit asks that a jury find Mr. Trump liable for battery and defamation, order him to retract statements questioning her truthfulness and award her monetary damages.
The jury will determine how much, if anything, to award Ms. Carroll based on the suffering jury members believe she experienced.”
Which says she has a lot of class as well as courage. This is going to be a benchmark case and encourage many other women who have been abused to come forward. You go girls!

Since I don’t know this defense witness’ name I can’t look up their credentials. I wouldn’t be surprised if they are second-rate at best. But I also feel we might be dealing with the “Everything Trump touches dies” syndrome. Even a hack “professional” witness that makes questionable claims for a fee might not want anything to do with Trump or this case. It’s a loser and I doubt much appearance money was promised in the first place. Unless it was enough to fund a comfy retirement it probably just wasn’t worth it. Even sleazebag lawyers might be hesitant to hire someone bound to get torn to pieces in a case that would get national attention!. So perhaps the witness bailed to protect their career, such as it is.
More to the point, we’ve spent the past few years dealing with COVID and trials have still proceeded. If this witness was experiencing real health problems that would prevent him from being able to appear in court (especially if the court date would be reasonably known beforehand), then arrangements could’ve been made for him to testify via videoconferencing.
I mean, I was summoned for jury duty in October of 2021 and COVID precautions were still in effect (masks were provided; we had some distancing between the potential jurors; etc) so it’s not like all trials were just called off during the pandemic so if Tacopina REALLY needed the guy’s testimony, there were ways it could’ve been handled–even with the “health problems.” (Unless the guy was on death’s door, I don’t see why accommodations couldn’t be made for him to testify.)

So is everyone else that has served, and when I think of those terrible wounds my dad suffered in a bombing mission over Germany in WWII, or that of a member of my church growing up who survived the Bataan Death March and those brutal years of captivity, all those people I’ve known who served and worse experienced war, some of whom were like my dad badly wounded and yes I’ve known some who got shipped back home in coffins I alternate between grief and rage. A country filled with tens of millions of people like you isn’t worthy of all the service and sacrifice given by so many.
