Oh, my God! This smackdown was delicious. And one of the reasons that it was so delicious was because normally the brotherhood and sisterhood of the judicial system is rather collegial. If it is necessary for an appellate court to overturn a lower court ruling, they strive to do so in as old and inoffensive a manner as possible. There, there Johnny, I know you did your best, just try a bit harder next time and you’ll be fine.
Not this time. Not today. A few hours ago the 3 member panel of the 11th Circuit Court of Appeals, 2 of whom were appointed by Trump, and 1 appointed by George W Bush went full Terminator on Trump, his imbecilic lawyers, and his lap poodle, federal judge Aileen Cannon.
In a scathing indictment of Trump, his legal lemmings, and especially federal judge Aileen Cannon, the 11th appellate court fired a torpedo under the waterline of Trump’s bogus Special Master claim. They totally trashed Trump’s lawyer’s claims that because he was a former President, he somehow had extra rights under the law that nobody else does. One judge opined that Trump’s lawyer’s arguments were largely incoherent and bereft of legal logic.
But surprisingly enough, the 3-judge panel reserved most of their judicial vitriol for Trump’s Kiddie Kourt Judge, Aileen Cannon. They not only ripped her on her tortuous legal reasoning in finding a path to appoint the darn Special Master in the first place, they then went in for the kill shot. They bluntly advised Judge Cannon that since the Mar-A-Lago documents case was already under a different federal court judge in Palm Beach County, who had issued the original search warrant, she had No authority or jurisdiction to ever hear the original case in the first place. They overturned her original decision to appoint the Special Master, and basically buried her ruling from the record.
This ruling is YUGE for several reasons. First of all, since the 3-judge panel included the Chief Judge of the appellate court, it offered cold comfort for Trump’s lawyers trying to ask for a full circuit panel review. Second, even the Trump heavy SCOTUS has been loathe to even touch this mega turd. They turned him down once, and they’ll do it again.
But more important is the judicial precedent involved. When Trump’s judicial lap poodle ruled to appoint a Special master to Trump’s case, it opened a Pandora’s Box nobody wanted. What Cannon’s ruling did was to open a door for any federal defendant subject to a search warrant to go before a federal judge and demand a Special Master, cuz Trump got one and everybody is equal under the law. The way the appellate court phrased their decision slammed the lid on that coffin.
So it’s over. The DOJ now has full possession and control of all of the documents recovered from Mar-A-Lago and are free to continue their investigation. Trump sees his uninterrupted losing streak in front of federal judges that he appointed continue. And I most certainly hope that Trumpkin federal judge Aileen Cannon loves her one room courthouse in BFE Florida, cuz she ain’t going anywhere else for the next 30 years or so. Justice is served.
So ends the legal career and relevance of Her Dishonor Judge Aileen Cannon, a judge too stupid to even be considered a useful pawn.
Well, one would hope so. But how exactly does that happen? She began her term a little over than two years ago so still has another six years to go, and depending on who is president six years from now, could be renominated. And if the Republicans, God forbid, control the senate at that time, she would be confirmed — unless the Republicans are a very different party by then — assuming there still is a Republican Party. Hell, she could even be put on the Supreme Court. But yes, let’s enjoy the moment — and all its ripple effects.
Even leaving out who she was covering for, there’s no denying she was inept in how she handled things. You get THIS smacked down by fellow Republican appointees, that’s a signal that you are no longer useful to anyone.
