This would certainly be a hoot if it came to pass. Melania Trump’s hubby is facing 34 felony counts of falsifying business records, to which he has of course pleaded not guilty. That’s his style, not guilty of anything, ever. For her part, Melania has left hubby to his own devices. She’s certainly not the loving spouse in attendance to show moral support — or at least to kick him under the table and nudge him awake. But not being there because you don’t want to be is one thing and refusing to obey a directive from the court is something else altogether and the latter may take place.

Although it’s unclear if Melania will be called to testify in her husband’s criminal trial, legal experts told Newsweek the prosecution could legally force her to take the stand. Newsweek:

“If Melania is subpoenaed by the prosecution, she would have to testify unless she can assert some sort of privilege,” former federal prosecutor Neama Rahmani told Newsweek.

Rahmani said the obvious privilege, in this case, would be a spousal privilege, which is codified into New York law and “protects the confidential communications between spouses during the course of the marriage.”

But while it’s possible that the government could go after Melania procedurally in an attempt to force her to show up as a trial witness, “the likelihood of that occurring is extremely low to non-existent,” former federal prosecutor and elected state attorney Michael McAuliffe told Newsweek.

McAuliffe said that was because Melania has no involvement in the underlying allegations that Trump had an affair with Clifford.

“In fact, she’s the putative victim in the illicit sex part of the story,” he said.

Perhaps. Again, to even assume that Melania was in any way the “victim” one has to assume that the Trumps have something like a normal marriage, i.e., an intense emotional connection that led them to get married in the first place. They’ve both been pretty clear about the situation, that she is his ornament and he is her wallet and that’s the connection. Melania was accused of being a gold digger early on and she replied, “If I didn’t look like this would he want me?” And the answer to that is emphatically “no.”

Trump wants and needs ornaments, although Marla Maples was swept up in his line of bullshit for a while, at least reportedly. Again, who knows?

I seriously doubt if Melania will be called to testify. She will invoke spousal privilege. But it is amusing to contemplate. And what about the other family members? They’re all adults and yes, they may be called to testify. This trial is only just now gearing up. Ivanka would be uber polite and claim not to know anything or remember anything beyond her own name. And even that might slip her mind.

Junior would try to make a witty joke out of all of it. He would fall flat on his ass doing so, as he continually does, but that doesn’t stop him from using that MO over and over again.

And then there’s brother Eric, and he will cop an attitude of faux outrage. That’s his MO. He’ll also make up some kind of cockamamie story about how he was too busy pouring cement or running a forklift to have paid much attention to anything that his father was saying or doing.

It will be intriguing once the family shows up. Of that you may be certain.

  1. as to Eric I have a question. has the Trump organization actually built anything in years? where is he pouring this cement? I pretty sure that wasn’t asked during the fraud trial but maybe it should have been. as far as I know they just do rentals for their own properties and manage some others.
