Now a little over five weeks into the Trump administration, the reckless rush to break the government is apace, and as expected we have the coming court orders pertaining to nearly every single individual action. In nearly every case the judges so far have definitely wanted to hear more about what is going on and if it’s legal. Thus, due to the fact that there would otherwise be permanent harm if not stopped during the evaluations, the anticipated injunctions have also come down freezing some of the worst possible DOGE abuses in their tracks – at least until the judges can sort out whose rights about those actions. We are now front and center having to address whether the Trump administration thinks it is special and can be the first administration to simply ignore court orders, or what Rachel Maddow last night called an “effective declaration of war” against the United States and the end of the republic.
We have quotes from the show as brought to us by Rawstory:
President Donald Trump potentially ignoring a court order sparked by his administration’s foreign aid freeze could explode into a full-on constitutional crisis — “and effectively end the republic,
“They have been joking about this and making, you know, macho sounding bluffs about this for a long time now – particularly from the vice president – J.D. Vance. How is the Supreme Court going to deal with it now that it’s real?”
Well, that probably depends on the SCOTUS’s evaluation of just how far out there the administration has gone. As for whether they are willing to sit back and watch lower court orders – or theirs, ignored, that depends a bit on whether they value their job. There is little point in being a justice if the issue is “moot” on arrival because the party in power doesn’t care at all what may issue.
“[Does the Supreme Court] try to give [Trump] what he wants from the courts so that Trump doesn’t break that glass? Doesn’t, you know, smash through the brightest bright line that we have and effectively end the republic? Do they appease him because they – ‘oh, he’s so scary, we better not make him defy a court order – we better make sure all court orders go his way.’”
Probably not. It seems unlikely they’d allow his threats to actually impact their opinions and rulings. But whether they’d go out of their way to use what is often referenced as the Court’s “inherent authority to enforce its order” is another question. It likely gets down which party really has the stomach to push it that far already – there’s a lot of time left to go in this administration and it’s not really clear to me that the White House wants to really explore those extremes just yet. As big and bad as they definitely see themselves, it is not like it’s wholly without risk.
“Will the Court make clear to him that his powers as president actually don’t allow him to defy the court. Do they tell him that if he does try to defy the courts, he is effectively declaring war on the United States of America? We’ll see.”
Maddow told viewers to keep their “eyes wide open on that and take it with all the seriousness it deserves.”
Anyone telling you they know how all this will play out is lying. Even Donald Trump cannot be certain – things change, stances change, the voters change, it can be a bit surprising. Certainly, the administration to this point has leaned in hard on their bigger than expected victory. But again, it’s not like there aren’t ramifications to losing 20% of their support in the polls, scaring Congress, having townhalls in a fury – we’ve already seen the beginning stages and we’ve already seen that they matter, at least to Congress.
But yes, keep your eyes open and – well, you already know. The moment the executive starts trampling over other branches? Yes, that is the end of our Constitutional Republic, the rule of law, civil rights, and predictability in American life. Oh! And really pay attention to that last one because the fourth branch – big money – really really hates losing predictability in their biggest market – the U.S. and the people within. Not good for business and boy does that ever matter. That’s non-partisan.

So, looks like the Sub-prime Court may come to regret giving the POTUS so much power.
You’d think they’d be smart enough to realize that the last thing an authoritarian needs is a “supreme” anything.
The unnecessary delay by Roberts is astounding. Couldn’t he just say “It’s part of his “official duties” but we’ll have to look at it in more detail? And then delay stopping the damages until they, yawn, get around to it sometime in, oh say, October?
October of what year?
C’mon, we all know the SubP_rime Court is completely in the bag for Trump. They will let him assume ALL powers under the constitution because, well because they don’t believe in Democracy any more than he does. We are all well and truly screwed! I predict the Court will say “yes” to ANYTHING President Musk wants.
each time scotus rules for corporations and Trump, they r getting a cut and are on the take.
Well, at least Clarence is. But I suspect the others do too
Actually, the ‘fourth branch’, also known as ‘The Fourth Estate’ is supposed to be a free and sceptical, questioning press. But we know that was the first thing they got rid of. It’s interesting that the most probing, direct, and cogent questions addressed to Dimwit Donny at the Starmer press conference came from British reporters, used to asking hard questions.
Fortunately nowadays the fourth estate encompasses the whole of the media landscape including great blogs like Politizoom.
Does the highest court in the land go with condoning and appeasement of a bunch of mad men or do they understand that in doing so they make themselves moot? Well, I’m no odds maker but at this point I’d say it’s a pick’em. Will it be ideology over duty or the opposite is about as clear as mud. The only bright spot I can see is that sometimes the noise from the streets does penetrate the chambers where these strange beings do their cogitating. Plus, we must remember these beings have a driving desire to stay relevant, otherwise they’d be out in a pasture somewhere grazing given some of their ages.
