When you start reading this, it might not seem like that big a deal, but underneath the surface, there are national implications, especially if the DOJ decides to go all in on Traitor Tot.

A few weeks ago, it made a minor national stir when a New Mexico court found that an elected state employee had been found guilty of violating the 3rd clause of the 14th Amendment, better known as The Insurrection Act, which removes any elected public servant from serving, and barred them from future public elected service if they were found to have supported, participated in, or aiding and abetting in an insurrection of the United States. One down, hundreds to go, right?

This shouldn’t be the first time you’ve heard or read about the 3rd clause of the 14th Amendment. In past months, state legal activist groups have tried to bar both NC Representative Madison Cawthorn as well as Georgia Representative Marjorie Taylor Greene. Both of those efforts failed.

But now we have another one. On her weekly show tonight, Rachel Maddow announced late in the program that an Alaska state judge had just determined that a sitting Alaska state representative was highly unlikely to serve due to the insurrection clause. In fact, the representative in on the ballot in November, and the judge ruled that even if he wins, the state cannot certify his win until his eligibility is determined. This ass clown is a lifetime member of The Oathkeepers.

Here’s the McGuffin. The Alaska judge wasn’t referencing the 3rd clause of the 14th Amendment. Instead the judge was referencing the Alaska state constitution clause dealing with insurrection against the government. This is important because this shitheels can’t appeal to SCOTUS, only to the Alaska state Supreme Court.

This may seem like local magistrate legal wrangling on the surface, but it has national implications. Because now you have both a federal court, as well as a state court that have both directly termed what happened on January 6th as an insurrection. And that comes dangerously close to establishing legal precedent.

Oath Kreepers founder Elmer Stuart Rhodes trial for seditious conspiracy started with jury selection today. A part of seditious conspiracy is taking part in a violent insurrection. And now the prosecutors have two separate court rulings that they can show to the court defining January 6th as an insurrection.

This matters. And not just for any charges tying Trump to the insurrection. The fact that multiple courts have now determined that January 6th was an insurrection makes it easier to charge Trump with same. But also easier to charge dickweeds like Peter Navarro and John Eastman with fomenting an insurrection. It also puts Enrique Tarrio, the founder of the Proud Boys in more mortal peril, possible leading him to flip.

From small acorns do mighty oaks grow. Ever since the 2020 election we have seen the judiciary stand tall before the man to protect our frail democracy. And now, once again, lower courts are taking the lead in calling a spade a spade. This is good news for the country, and our democracy.

          Criminal investigations involving elected officials, especially rich ones and large numbers of co-defendants,take time. This isn’t an episode of Law and Order where some punk is caught and tried in 45minutes. This is the investigation of a former president and sitting members if the House,and Senate. They have to get it right, crossing every “t” and dotting every “i”.

          The feds are doing exactly what they should be doing. First you go after the low changing fruit, idiots like you who were caught up in the riot and were simply trespassers,and vandals. They take plea deals and turn on the lower level.planners. They in turn go to local.leadership. Then the feds hit the real.arseholes.
          This is why they got the rank and file Proud Boys and Nazis first, then the national leadership.

          Insurrection isn’t easy to prove. Neither is conspiracy. But when rank and file types finger local.leaders,and those leaders give up.the national.leadership and testify that this was what they were to do establishes the kind of planning necessary. We are at that stage now. The national.leaders are going on trial. If they have a,shred of intelligence they will provide info on which Trump administration people were in contact with them and helped plan this. Phone logs and confiscated phones help.prove this. And Fat Donnie knew what was happening and sat on his fat ass watching all hell.break loose despite being begged to.issue a condemn story ststement, and refused.

          Even if they cannot get Donnie Donuts on conspt, there is the concurrent but separate investigation into the documents he stole. Contrary to.his dimwitted belief, the president cannot cart off classified or even nonclassified material which are official deocuments. Sure, he can take photos of himself and a porn star or a foreign leader and press clipping slight not briefing papers,or other documents. The president doesn’t own them. The American people do, and they are kept in the secure National Archives. And no,,Obama didn’t steal 33,000 documents, many classidied. That has been debunked many times by legal.experts,and the Archives. Nor can the president take a,Sharp ie and cross out “classified.” Normally, if it involves national securitu, the intel.agencies and military have a,fair amount of say. Your guy has very likely revealed the names of foreign nationals who gave information to us, usually in opposition to draconian foreign policy from their respective governments. Some of those people may be dead as a,result, making the moron guilty of voluntary manslaughter.

          • It took 2years to get Nixon on Watergate, and he avoided a,trial.by resigning. We only got rid of him because the loan hanging fruit turned on him,,and eventually so did John Dean. And his crimes didn’t come close to what Don the Con has done. Nobody died. Tricky Dickie didn’t refuse to release transcripts of his tete a,tetes the leader of our worst enemy as,Fat Boy did with Putin. Those transcripts should be in the Archives. What was he hiding? What did he shred and flush down a toilet? What is he hiding that he doesn’t want future historians to see?

  2. Murph, when I moaned before (on the 23rd, “Just when McDonnell …”) about your using the term “Here’s the McGuffin” wrongly, you replied with an uncited definition:

    an object or device in a movie or a book that serves merely as a trigger for the plot

    – and have continued to use it as if you were vindicated. (Though I’m grateful for the apparent reference to my objection in your very next use of it!)
    But surely this definition proves my point? And the consensus of definitions from online dictionaries only reinforces the “merely” nature. You’re still using it with this weak meaning of “Here’s the thing” rather than “merely” a red herring – and necessarily in fiction, too. (And as everyone points out, Trump is too fantastical to even be credible fiction.)

    Perhaps some PZ court could make a ruling on this? !
