This isn’t Mike Pence’s week. A sales check showing what a cheapskate tipper he is went viral and then he had to cancel his vacation to Israel because he has to stay in town to babysit Donald Trump, and then Louie Gohmert, the dumbest man in Congress, sued him to compel a court to rule that an 1887 electoral college law is invalid and Pence should decide who the electoral college electors will be and overturn the results of the election. And that suit got hammered today, after Pence requested that a judge throw it out. Washington Post:
Vice President Pence asked a judge late Thursday to reject a lawsuit that aims to expand his power to use a congressional ceremony to overturn the presidential election, arguing that he is not the right person to sue over the issue.
The filing will come as a disappointment to supporters of President Trump, who hoped that Pence would attempt to reject some of President-elect Joe Biden’s electoral college votes and recognize votes for Trump instead when Congress meets next week to certify the November election.
Here’s what a Justice Department lawyer said.
The Vice President is not the proper defendant to this lawsuit,” wrote Deputy Assistant Attorney General John V. Coghlan.
“The Vice President — the only defendant in this case — is ironically the very person whose power they seek to promote,” he added. “A suit to establish that the Vice President has discretion over the count, filed against the Vice President, is a walking legal contradiction.”
Instead, Coghlan wrote that Congress was the proper defendant for such a suit.
Coghlan wrote that the lawsuit has other problems, too, and that, as a result, the judge should reject the suit, particularly given the limited timeline before next week’s vote, without trying to weigh difficult and never-before-tested constitutional issues.
Maybe Gohmert will sue Congress next, who knows? All that is important is that this is grandstanding for the base, an opportunity to stay in the limelight and an opportunity to keep grifting.

Mike Dunford has been reading this filing, and the one from the House, and commenting on Twitter. He and Akiva Cohen have been shredding these suits.
I’ve got a feeling a student on his first day in an “Introduction to Constitutional Law” class would be able to shred Gohmert’s suit.
You do have to admit, though: With all the frivolous suits that have been filed in the past 2 months (both before and after the election), Constitutional Law professors and their classes will be having field weeks (if not months) covering these suits and pointing out all the flaws. Professors will be challenging the students with topics such as “How could this suit have been filed so it stood a snowball’s chance on the Sun of succeeding?” and “If you were a judge hearing one of these suits, would you be more likely to blow your top and scream profanities at these idiotic attorneys or find yourself rolling on the floor laughing out loud and asking them how they ever managed to pass the bar given how stupid they seem?”
Writing a judge’s response would be an amusing exercise
There is no case so ridiculous that a lawyer can’t be found to file it, given a large enough retainer in advance.
