Curiouser and curiouser. It seems that two powerhouses will come together to work against Trump, and we couldn’t be happier! Trump has been screwing up left and right regarding his 10 billion defamation case against the BBC. He didn’t like the way they cut parts of his J6 speech together, and he thinks that he didn’t really tell the rioters to go to the Capitol building to stop the official business that day.
We know better. So does the BBC. But they did the gracious thing and apologized. We also all know Trump is going to try to wring billions from a stone, because he loves his lawsuits. In this case, he is trying to make himself the good guy. It hasn’t worked yet, and it will continue to *not* work.
Trump and his lawyers are trying to say that Mr. Smith has no direct knowledge of Trump’s state of mind that day. Oh? Really? Considering he spent years looking at Trump and the insurrection, he knows a whole lot more than Trump thinks he does. Remember, we were told straight out that Mr. Smith *would have* put Trump away. Period. That means a lot more than Trump would think. He barely thinks as it is. And Mr. Smith’s report of that day was *publicly* released, so all of us could look at it, too. That means a LOT. Mr. Smith was confident enough to release it to the public. [There is also a chance the documents report will be released.]
Jack Smith has been subpoenaed to make a deposition. He did not object. He probably can’t be described as gleeful, but the idea is entertaining for him to be so. It’s not a surprise that he would be happy to testify. He may very well know Trump’s state of mind that day better than Trump does, especially since years have passed and Trump is aging badly. That report is *dense*.
Trump thinks he can control evidence from that day that the BBC could use on its own behalf. No, he dragged his feet and tried the fast talk, which took so long that the BBC was told it *could* gather evidence. Trump cannot block them. Now the BBC has added the possibility of a deposition from Jack Smith, and *that* will make Trump sweat. It should! Plus, Trump will not remember Mr. Smith’s background (remember the war crimes tribunal?) as well as Jack Smith’s prosecutorial experience.
The way the chips are falling, this lawsuit will go nowhere. Yes, the BBC will have its legal costs, but the chance to beat Trump at his own game is stellar. They will have far more information to use for defense than Trump will have for offense. He thinks they’re going to cave. Can’t see the BBC doing that. Not like some organizations and schools caved here. (Fools.)
Incidentally, the one and only Chief Judge James Bad-A$$ Boasberg is currently reviewing a separate request from the BBC to unseal other records, although the specifics were not stated in this current article. Let’s add a bit of information, with appreciation for Raw Story:
A judge will now decide whether Smith can be questioned under oath. Legal journalist Adam Klasfeld pointed out Monday that Trump canceled his deposition scheduled for Oct. 16 because of “matters of national importance.” “The BBC alerts the judge that those matters were: a rally in Dalton, Ga., and a fundraiser at Mar-a-Lago,” he wrote.
Yes, really. That isn’t even close to national importance except in Trump’s mind, because everything he does is of “national importance”. At least he hasn’t called golf of national importance. Yet. He’s too busy screwing people and countries. For example, if you haven’t read it yet, see Denis’s article from earlier today here.
But it really now seems that Trump and his pro bono (maybe?) lawyers aren’t really going to have a leg to stand on when it comes down to actually going to court, especially if Mr. Smith is able to provide a deposition. He’s going to skewer Trump and set him on fire, figuratively speaking. Let’s hope Jack Smith can do this. Apparently there’s some sort of permission needed for him to do so. Trump is going to lose and be embarrassed. Good times.
Friends, I know everybody begs you for money. I promise you that, of all the outlets bugging you for spare change, we are the smallest and the hardest-working. We’re a bunch of old, disabled people, except for one writer in his mid-50s. But the rest of us are in our sixties and seventies, and this is a labor of love. All we’re asking for is the ability to continue our quest to tell the truth about Trump and help ensure democracy survives. If you can help, please do. Thank you. Ursula
