Ho Ho Ho. The DOJ lawyers are to make their case for why the migrant flights continuing to El Salvador did not violate Judge James Boasberg’s order. Shortly after the invoking of the Alien Enemies Act and migrants were gathered up, a civil rights group representing the Venezuelans mounted a legal challenge “The so-called show cause hearing represents the closest a federal judge has come to deciding whether the administration has defied a judicial command. Thursday’s hearing goes much further as it’s the first step in Boasberg potentially holding officials in contempt and possibly ordering sanctions.” Well, how about that? Of course, look at who has this case.
I knew the judge would not back down. I *knew* it. All this, as well as his other case regarding the administration, have showed that he looks at and obeys the LAW. Imagine that?! There are a couple others that, as we have seen recently, are nearly on his level but not quite there. I believe this was the first case concerning one of Traitor Tot’s Executive Actions. I expect the DOJ lawyers figured this was an easy, open-and-shut case. Not so fast, kids! Who do you think you’re facing?
“The case has emerged as one of the highest-profile and most contentious court battles of President Donald Trump’s second term, with the president calling for Boasberg’s impeachment over his handling of the matter, leading to a rare rebuke of the rhetoric from Chief Justice John Roberts.” That would be “For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,” Roberts said in a statement released by the Supreme Court. “The normal appellate review process exists for that purpose.” That made my head fall off and roll around on the floor. It was about the LAST thing I would ever expect from a conservative Supreme Court!!!!
May I remind you that Judge Boasberg is following LAW? Right now, the administration has reason to hate him on this. For the first one, it was a simple question he posed to them, too. Did you or didn’t you ignore my order? Instead of answering, the DOJ attorneys have hemmed and hawed and dodged left and right, up and down, to NOT give him that information. Then they invoked “state secrets”. Oy. Why didn’t they just do that in the first place? You and I know they ignored it but the judge cannot accept hearsay. This one may actually get up to the Supreme Court. I can’t call a yes or no from the SC, so I have no idea how this might come out if they get it.
Judge Boasberg is determined to get to the foundation of this. Two flights containing migrants continued to El Salvador the day of the hearing. The DOJ lawyers said it was only an oral directive (to turn the planes around) and “did not amount to a binding injunction” and was not in his written order, except the written order covered it, just not specifically, but covered it! He vowed to “get to the bottom of whether they violated my order – who ordered this and what the consequences will be.” WOW. Yea, it’s a song and dance from the lawyers.
Now, by this time, you all know how much respect and admiration I have for this judge. He is following the LAW. Ignoring his request, now a demand, is *not* a good idea. And if someone *cough*OrangeSphincter*cough* tries to intimidate him, it won’t work as it has not worked thus far and I doubt it will *ever* work. Good stuff!!!!!
