Not surprisingly, demented Donald, America’s first king — or at least that’s how he’s taking it — is strong arming the candidates for Senate Majority Leader by demanding that they stop the functioning of the Senate if they want the job. And no, he doesn’t know that he doesn’t control the legislative branch. Trump doesn’t know how anything works, other than putting up a media spectacle that is sufficient to entrance guillible Americans. Spectacle is what he knows how to do. But reality is not something he does well. Here we go with Fascism 101, and it’s only been five days.
Elon doesn’t know how things work either. But believe me when I tell you, Twitter/X is aflame with right-wingers insisting that this is a great idea. Trump’s tweet ends “what they did four years ago, and we cannot let it happen again. We need positions filled IMMEDIATELY! Additionally, no Judges should be approved during this period of time because the Democrats are looking to ram through their Judges as the Republicans fight over Leadership. THIS IS NOT ACCEPTABLE. THANK YOU!”

Under the Constitution, judges are appointed by the President and must be confirmed by the Senate. It’s not a matter of just “recess appointments” or bending rules. And this isn’t a new process; the rules for how judges get their seats have been established for centuries.

The kicker? Trump’s plea here flies in the face of his own actions. Remember, in 2020 he rushed to confirm a Supreme Court justice, Amy Coney Barrett, just weeks before an election. And in 2016, his Republican allies blocked Obama’s nominee Merrick Garland for nearly a year, claiming it was too close to the election.

Yet here we are, with Trump demanding that Democrats not confirm judges now, just because it doesn’t suit him. Hypocrisy at its finest. He also pushes a misguided notion that Senate leadership should cater to his demands for recess appointments. But the Supreme Court clarified in NLRB v. Noel Canning that recess appointments are only permissible during a formal Senate recess, which the Senate often avoids by holding pro forma sessions.

So Trump’s vision of “filling positions immediately” just doesn’t fly legally. The “two years or more” claim? That’s just playing the drama card. Confirmations don’t typically take that long, and if they did, well, Republicans had their hands on the gavel, fast-tracking Trump’s nominees to record numbers, many during his lame-duck period. So let’s not act like Democrats are somehow pulling a first-time trick here.

This analysis is simple and correct. But King Donald doesn’t want to do anything according to the rules. He is power mad and drunk on vainglory right now. He simply wants to tell everybody in government what to do and how to do it, whether it is legal or not. We have a man in power who has never read the Constitution — and even if he had it, he has no intention of following it.

Trump wouldn’t have had Aileen Cannon hearing his case if that “two years” thing were real. Cannon was nominated in MAY of 2020, her nomination was reported out of committee in September of 2020 and she was confirmed on November 12, 2020, just NINE DAYS after the election (while Trump was busy making calls to “find” more votes and trying to file pointless lawsuit after pointless lawsuit challenging the election’s results).
On another point, if it weren’t for “hypocrisy,” Republicans wouldn’t have ANY principles at all.
