SCOTUS Conservatives Decline Hearing Immunity Appeal, Deny Justice Too

I probably shouldn’t write when I’m this angry but what the hell. I finished an article earlier and turned on the new and F**K! SCOTUS has declined Jack Smith’s motion for an expedited hearing and ruling on Trump’s claim of Presidential Immunity. I first want to point out that it took them all of two days (less than that actually) to review the matter and say “Nope.” I’ll have more to say on THAT.

I am however as I said supremely pissed off.  (pun intended) It turns out SCOTUS was just teasing us, like that legendary stripper back before I was born with her famous “Fan Dance.” Asking for Trump’s response to Jack Smith’s requested for an expedited review of Trump’s Presidential Immunity claim by this past Wed. suggested they were ready to move on the matter.  It only take FOUR Justices to vote in favor of granting Certiorari, or in plain English to formally hear a case. Four. Six of the current Justices aren’t mere Republican appointees, with only one (Thomas) having been nominated by a President who got into Office winning the popular vote.  They are all, all of them longtime Federalist Society devotees. They were groomed for where they are.  I’m kicking myself for getting my hopes up.

Not that it does any good. Or the country any good. As The Hill reports there weren’t four Justices willing to at least hear the case:

While the Supreme Court agreed to expedited briefing over whether to formally take up the matter, the justices ultimately sided with Trump, who argued the case should first be considered by the District of Columbia Circuit Court of Appeals, which scheduled a Jan. 9 hearing.

The justices’ one-sentence order was unsigned and included no explanation.

I should note it’s common for a denial of this type to not include any reason or explanation. So don’t read anything into that part of it. What matters is what the linked article says about the Court’s rejection of Smith’s motion means they sided with Trump. That this “shouldn’t be rushed” as Trump’s lawyers argued. They argue there should be lots of time taken to weigh this matter. By which they mean AFTER the election when a newly installed President Trump can shut the whole thing down. Does anyone for one second think the Justices didn’t know that?

On the flip side, is there anyone who believes for one second the Justices didn’t know the “quiet part that Jack Smith couldn’t say” (as pundits are blathering about, I’ll get to that) which roughly goes like this: “Trump wants you to wait for the DC Court of Appeals who already dallied around for a month and half on a freaking gag order appeal. They might well take far longer to rule on Trump’s appeal. And THEN he has MORE time before he has to file an appeal to you guys if he loses which he likely will.  THAT means the trial date for March is blown. Maybe for months. Add in the conflict with Judge Cannon down in FL and it means if YOU don’t take up this case and rule before the end of January it will be well into the summer, if not the fall before we can go to trial. And we know at that point it will be a practical impossibility to do so. You know it. I know it. Trump knows it. EVERY American knows it. Everybody knows everybody else knows it! If you don’t deal with this and quickly Trump gets exactly what he wants which is no trial until after the election and the American voters will be deprived of facts and evidence they DESERVE to have.”

That’s what Smith couldn’t say in his legal filing. And that spider-web thin thread is what the conservatives of SCOTUS decided to hang their robes on.

Worse, I’m hearing pundits talk about this. They’re saying it’s oh so sad that Smith couldn’t say “the quiet part” so the poor little Justices couldn’t possibly be expected to figure it out. That Trump was once again USING the Courts and even THEM to run out the clock!  I’ve said it before, the bosses in the executive suites at news outlets want Trump ratings from him being the GOP candidate. AND that within minutes of the ruling marching orders were issued to their journalists and pundits – Give SCOTUS some cover or look for another job!

And SCOTUS? Well, the six Fascist Federalist Society F**kwads have revealed their hand. They’ve effectively blown the DC trial date and in all likelihood the prospect of any Trump trial in federal court prior to the election.  Sure, they’d ruled against him in the past. But this is crunch time. The one that really counts. They see the polling too, as in the polling that plenty of Republicans won’t support Trump being the nominee if he’s convicted somewhere. So they’re telling Trump “We’ve got your back.” Worse, they are telling the country the same thing. That Trump is in fact above the law and like the Borg from Star Trek: The Next Generation saying “Resistance if futile.”

I’ll leave you with this. SCOTUS could have heard and disposed of this matter before the end of January and preserved the March trial date. In the past SCOTUS has move swiftly. They did with Nixon fifty years ago. The moved even more swiftly (a few days from accepting the case to issuing a ruling literally deciding the outcome of a Presidential election) in 2000 with Bush v Gore. Don’t let anyone tell you SCOTUS couldn’t have done what Smith asked them to do. There’s ample precedent for skipping the appellate court level including in huge cases. There’s also as I said ample precedent, modern precedent in fact for SCOTUS to hear a case with weighty legal issues that are of the utmost national importance and urgency, and then rule quickly.

Not one of the six conservatives would allow that to happen here. I can’t write what I truly think of Roberts and his cronies on SCOTUS. Ursula is cool and when we talk has no problem when my language gets particularly “colorful” but she’s never heard me truly cut loose. I like being able to post here so as I said I’ll shut up for now.

Almost all the time I dream of Trump rotting away in prison, dying a lonely death. Right now I hope, I really do he keeps laughing so hard over his win (and make no mistake it was a huge win for him) that he accidently gets a piece of his burnt steak dinner lodged in his throat and chokes to death this evening.
