Trump’s SCOTUS Pick Has Already Committed To ‘Put Nail In Coffin’ Of Congress’ Ability To Investigate President

This is beyond alarming. CNN dug up video of Brett Kavanaugh being asked what case he would overturn if he could. He hemmed and hawed and then said, “Actually, I’m going to say one. Morrison v. Olson. It’s been effectively overruled, but I would put the final nail in.”

Morrison v. Olson is a Supreme Court decision that upheld the constitutionality of provisions creating an independent counsel under the 1978 Ethics in Government Act. Later, in 1999, when the independent counsel law expired it was replaced by the Department of Justice’s special counsel regulation. That regulation is what Robert Mueller is now operating under now.

But Brett Kavanaugh believes in executive power. Now he didn’t used to, back in the day when he worked with Ken Starr on the Bill Clinton investigation, but now he believes that the president should be immune from prosecution.

Kavanaugh believes that “the president should be excused from some of the burdens of ordinary citizenship while serving in office.” He says that the Chief Executive shouldn’t be indicted, sued, or even investigated.

If he gets confirmed and puts the “final nail in” by overturning the Morrison case, that could end the Mueller probe and also dismantle any possibility of future investigations of sitting presidents. And that could set the stage for tyranny.
