Brett Kavanaugh.
That’s the name that supposedly came up yesterday as the “D.C. Circuit” court of appeals judge whom Trump has already picked as his next Supreme Court nominee.
Of course he has.
After all, who else, among the Heritage Foundation approved (meaning preapproved to vote far right in all situations) has recently written a law review article arguing that it should be impossible to investigate and/or file a civil suit against the president while he (or she) sits as president? Umm, none.
Note the timing.
Kavanaugh’s article didn’t come out while Obama was president. Obama endured a legal colonoscopy about everything from Benghazi to the IRS non-scandal (where the only group denied their 501(c)(3) status was a LIBERAL group that advocated a pro-choice stance). And, no, Kavanaugh’s article didn’t come out when he served as Ken Starr’s top deputy when they abandoned their search for a scandal having to do with Whitewater and declared themselves free-range prosecutors, looking for something Clinton did wrong. Credit where due, they eventually came up with charging him with lying when Clinton answered” “No” when asked “IS there an affair between you and an intern named Lewisnkey?” They hadn’t “seen” each other in months, and had broken things off much earlier, Clinton said “no” – there IS no affair between us. Thus the famous, it depends on what the meaning of “is” is.
We have digressed, as we are prone to do. No, Judge Brett Kavanaugh, who is like 23 (or he’s 53, but 53 is the new 23) and being 23 in Judge years, ensures he’ll be haunting our court with shockingly conservatives views for likely the greater part of 30 years, 40 is not out of the question, and appointed by a man likely to face felony charges sooner or later.
We need not point out that Kavanaugh will be taking the seat of what had been the “swing vote” – the one vote liberals had. We certainly never counted on Kennedy for an economic vote, never. But, he did seem to support reproductive rights, have some compassion toward women, and did vote to grant gay marriage, that’s a lot of rights owing to one man, and rights that definitely would NOT be granted under young judge Kavanaugh.
Again, we’re getting away from the main point.
There’s not an ounce of daylight between the judges put forward by the Heritage Foundation as “satisfactory” in terms of their right-wing bona fides or they wouldn’t be on the damn list! (What other president needs a “list” to pick a judge?) There is however only one, just one, who is on the record stating that the president, at least while president, is above the law, and it happens to be the guy that Trump supposedly told guests at a picnic yesterday was his choice.
Trump is about to name the judge that would make up the majority of any major case that came up to the Supreme Court. We – the collective citizens of the United States – about to let Trump do so. I wrote yesterday (I think, all the days seem to run together now) that if one doubts they live under a dictator, watch what Trump did to Harley-Davidson, in essence use his Twitter-bully-platform to destroy the company. If that didn’t persuade you, picking a Supreme Court judge based primarily on the fact that he’s got your backside (but not Obama or Clinton’s) ought to make you sit back and think.
In fact, if one really wanted to engage in some cynicism, one might wonder what it was that caused young Brett (he will never be a real SCOTUS judge to me because he will have been selected by a felon, more than likely), just what motivated young Brett to feel the need to publish such an article in the last year or so? It is not like “presidential scandals” or “presidential investigations” are new. Why oh why would he so suddenly feel the need to be heard now?
The only thing really new is that almost half the country is cheering loudly as they lose their freedoms. Oh,poor Robert Mueller is newly up against more than he ever dreamed. I suspect that he took the job thinking that he needed to simply get to the bottom of what happened. The bottom would speak for itself. Instead, he’s seeing that the rock bottom is governing the country, and doesn’t give what the hell else might be found down there.
