Clarification. An honest mistake. Earlier today I posted an article which attested that Special Counsel Jack Smith had already filed a 180 page motion in the J6 case in Washington DC. This was based on a segment on Chris Jansing Reports this morning where NBC News Legal Analyst Lisa Rubin gave very specific information about the filing.

This was in error. In fact what Smith had filed was a request to exceed the normal number of pages for the filing taking into consideration the complicated issue of presidential immunity. All I can say is that Lisa Rubin must have some wicked cool sources in the Smith camp, since it was her that outlined everything I put in my article.

Now on to the news. It was just reported on The Last Word that Judge Chutkan has already ruled on the prosecutions exception request, and she has approved it. And in her ruling, she called out Chief Justice Roberts’s mealy mouth decision as proof of the legitimacy of an expanded filing as being in line with the SCOTUS ruling. Chief Justicce Roberts. Stand up and take a bow, FOOL!

Then she went on to scold the Trump defense team like a bunch of small children. She squashed the Trump team for expediting the procedures by again quoting Chief Justice Roberts, telling her when he returned the case to her to act with all due dispatch. I wonder if the defense team requested a quick recess to change their Depends.

Then she went on to use legalese to basically call Trump’s legal beagles total morons. The Trump team protested the timing of the motion in the first place. Judge Chutkan went on to lecture I guess I must remind you how trials work. The prosecution files motions, the defense files a response to those motions, and then the judge either holds a hearing or rules on the written arguments. Hell. I never even got out Law 101, and I knew how that one went.

Then she proceeded to put a dagger in the heart of the defense, and in my earlier article I nailed it to a T. The defense bitterly complained about making such inflammatory information publicly available in the middle of an election when votes were already being cast. Chutkan coldly replied, I must again remind the defense that a political calendar has absolutely no bearing on a court calendar. The defendant is involved in a criminal trial, and will follow the courts calendar.

Long and short. Judge Chutkan granted the prosecutions request, and Smith is due to file his motion before close of business on Thursday. And after almost a year and a half of watchingt Smith like a hawk, I think I know what comes next.

There are bound to be things in the motion Smith files before the judge that he doesn’t want the public or the defense to see, such as witness names and addresses. The Trump team is going to try like hell to delay the release by contesting everything but the title. I’m betting that after Smith files his motion, he immediately files for the judge another copy of the filing, this one with redactions already in place for things that shouldn’t be made public. That should short circuit most of Trump’s legal D-Team’s protests. Don’t touch that dial.

    Judge Chutkan’s latest is a thing of beauty, essentially calling trump’s lawyers maroons, because…they are. It’s only six pages, but dripping with righteous fury at them, a great read. I’d already downloaded it, so don’t have a link to the pdf, but should be easy to find…and read.

  2. Judge Chutkan deftly spanks those drongos with knowledge, skills and experience, a quill and context specific words. How accomplished and competent. There’s simply no comparison, except possibly for the next spanking these drongos will sustain, from the no nonsense and most excellent Judge Chutkan!
