So called Justice Samuel “Illegitimate” Alito sniped from the friendly pages of The Wall Street Journal (well the not so friendly pages, I realize that many of you will not be able to read along, I stumbled upon a freebie I guess) that American citizens are perfectly free to question the opinions of this Supreme Court, but not it’s “legitimacy”.

To do so would apparently cross some imaginary line in his immensely small mind and hurt his widdle fee-fees I suppose…

“In a comment Tuesday to The Wall Street Journal, Justice Alito said: “It goes without saying that everyone is free to express disagreement with our decisions and to criticize our reasoning as they see fit. But saying or implying that the court is becoming an illegitimate institution or questioning our integrity crosses an important line.”

Now, Justice Roberts said very nearly the same thing earlier this year, but with one important difference, he didn’t say anything about crossing some sort of line, let alone an all so “important” one…

“Simply because people disagree with an opinion is not a basis for questioning the legitimacy of the court,” he told a judicial conference in Colorado Springs, Colo. The high court’s role, grounded in the Constitution, ”doesn’t change simply because people disagree with this opinion or that opinion or disagree with the particular mode of jurisprudence,” he (Roberts) said.

Lines, and the not crossing of them, are of the utmost importance to authoritarians like Alito who hew to the beliefs and prejudices they imbibed as a child to and expect others to drink of the same.

You, Alito, and the four fellows who voted with you to overturn the 50 year, set in concrete precedent of Roe V. Wade, established by a 7-2 majority of a court every bit and more legitimate as your own, for the glory of your imagined sky-gods and the approval of their gapped toothed adherents, are no longer representative of the nation you presume to rule with your edicts and have therefore lost all legitimacy.

As Justice Kagan said:

“A justice shouldn’t be a “textualist just when it leads to the outcomes that you personally happen to favor…

…“It just doesn’t look like law when some new judges appointed by a new president come in and just start tossing out the old stuff.”

In this case “the old stuff” being the hard won body autonomy wrested through decades of arduous court battles, by successive generations of women who won the right to vote in this country only one hundred years ago, and whom, within your and my lifetime and mine, Samuel, could not secure credit on their own.

No sir, you are not legitimate as an arbiter of their choice to carry and bear children in circumstances you can scarcely conceive yourself being.

You are not legitimate as overlord of the fates of the abused, of the molested, of the cruelly coerced, of the trafficked and raped, of those in circumstances in which you will never find yourself.

No sir, you and fellow pew mates are not legitimate.

I take your dare and cross your little fascist-pig line.

  1. Not that he’ll ever see this but conservatives come to this site so my respons is: Hey Alito – take your butt-hurt feelings and run away like Texas AG Ken Paxton fleeing a process server! Since you and your fellow Federalist Society GROOMED and appointed fascists have dropped all pretense of “whittling away” at rights and are taking a chain saw to them you asshole HAVE made your beloved Court ILLEGITIMATE! Bit by bit through successive generations SCOTUS has included more people in the rights set forth in our Constitution and laws. But YOU and your ilk believe the full blessings of Constitutional rights are ONLY for people like you – white, prosperous folks with YOUR religious views. And you and your fellow Fascists are hell bent on using your authority to IMPOSE your views/beliefs on us all.

    Are you that clueless that you can’t fathom how non fanatics like you consider what you’ve done and what you intend to do, especially with stolen SCOTUS seats allowing you to do it illegitimate?

  3. alito is on the court because bush ii was slapped down for his first choice. harriet myers was his first choice. because bush was a pussy he let the right wing push him around and ended up with alito who is really not really constitutional scholar but instead is a political hack.

    • Well, we would’ve been in worse shape with Myers, given her nomination was regarded with horror by liberals AND conservatives alike. But, probably the biggest blow to the nomination was the fact that the nomination was little more than cronyism since Bush had appointed her to the Texas Lottery Commission when he was the state’s Governor and she’d been a member of Dubya’s staff (he’d even put her in charge of gathering names to replace Sandra Day O’Connor).

  4. author and commenters, you guys should really look up the meaning of illegitimate. You presented no evidence as to why he is illegitimate other than the fact that he didn’t agree with his most recent predecessors. You have essentially argued that he is right when he said that you call him illegitimate because you don’t agree with him. If you are upset about roe v wade, give some arguments as to why the legal opinions of the justices were incorrect, not why you don’t like it. it makes this article seem juvenile and it makes you sound like crybabies. Use your brain and do some research.

    • Did you miss the ‘50 Year precedent’ and ‘lying under oath’ mentioned? Did you miss the comments about Ginny Thomas? I don’t get why you don’t see ‘court packing’ as part & parcel to illegitimate, but since your a MAGAt I don’t figure you’re tethered to reality let alone able to follow along….

  6. Great article, Dino! The ”legitimacy”of the High Court of a democracy lies in the free choice of a majority of its citizens, and THAT if the line that should not be crossed! Take THAT, “Justice” Alito!

  9. Thank you for this excellent piee. When the leak happened, amd even before during his and subsequent confirmation hearings of conservative Catholic judges,my immediate thought was that the responses they gave over “settled law” questions were bluffs that they clearly intended to ignore if the question came up of any law their personal religious dogmas disagreed with. Their clear intention was to simply ignore the first amendment prohibition of government (congressional) interference with personal religious practices.
    My other objection to Alito in particular was his statement, when the question of abortion first came before the court after his ascention, that since the constitution is silent on abortion, there is no constitutional right to it. Alito is following the right wing party line of fascistic control by choosing to believe the importance of law is to restrict rather than sustain liberties, should the constitution remain silent in a specific issue. This whole line of pharisitical rationalization is made clear in the twisting of Jewish law to decide what can and cannot be done in the sabbath, as illustrated in Michener’s novel about Israel.

    The question arose as to whether washing up dishes after a sabbath meal could be considered work or a part of the actual meal preparation , etc. Finally, washing up was prohibited because someone, like an antique Alito Pharisee observed that though washing up might be included in the mealtime activities, WHAT IF . . . after washing up someone threw the wash water out the window and a seed sprang up into a plant. AHA! Then the person would be guilty of sowing seeds on the sabbath which IS work. And so . . . can’t wash the dishes on the sabbath.
    All this is about control. There is that part of society that believes it has the obligation to control the actions of the rest of us. It is to this point that we have once more arrived on our history, and politically such behavior is known as fascism. Alito is just one more fascist pig clothed in the black robes of the false priesthood giving divine decrees from that great bench on high.
