This sounds pretty crazy but what was labeled “crazy” in our politics and in our law prior to Donald Trump and what is labeled crazy now, are two very different things. We’ve come a long way in this country since 2016, all of it downhill, as a result of the ongoing disintegration of the Republican party and the desperate hijinks that members of that party employ to hang on as long as they possibly can, and if at all possible dislodge Joe Biden and restore Trump to the Oval Office. Whatever you read between now and the end of the year about this election, bear that basic rationale for all things Republican in mind. A lot of Republicans can’t stand Trump but they view him as their only chance to hang onto the party. What most of them don’t seem to know is that the party is already lost and all that’s left is MAGA madness.

As you know, Judge Aileen Cannon heard two motions today. And Jack Smith ostensibly “won” today because Cannon refused Trump’s request to dismiss the case outright. BUT, something else happened today which is definitely worth your sitting up and taking notice. Trump is very worried about the obstruction charge and his violation of the Espionage Act generally speaking. Even Jeanine Pirro chimed in on that today, with her usual gibberish.

My point is that if Pirro is raving about it on Fox News, it’s a biggy. Now, here’s what took place shortly after the ruling on the other motion before Judge Cannon.

Trump is nervous about this particular charge because it is the strongest case against Donald Trump. The Espionage Act, obstruction — they’ve got him dead to rights. His only defense is he somehow declassified the documents in his mind like some Jedi mind trick is preposterous. If he can keep delaying it, he expects to be president again.

“Then he can order his attorney general to drop everything. Then he can appoint Aileen Cannon to the Supreme Court. Although it seems like Jack Smith won today because she didn’t boot the entire Espionage Act claim, she postponed her decision. She denied it without prejudice, meaning that Donald Trump can bring it up again in the middle of the trial, and if Judge Cannon agrees, in the middle of the trial, then double jeopardy attaches, and Jack Smith won’t be able to appeal it to the 11th circuit court of appeals and then Jack Smith is done on that claim. So, it’s a temporary victory.”

Now, I am not unmindful of what’s being inferred here and I basically go along with it, and that is that a federal court judge is possibly seeking to influence a case before her in favor of one of the parties. That is a pretty weighty allegation to make. Yet, there were crooked judges in Nazi Germany and the Republican party, as it collapses, seems to be imitating the 3rd Reich more and more with each passing day.

I have faith in Jack Smith. I think whatever curve ball is thrown his way, he’ll know how to field it and what to do. And let’s face it, Aileen Cannon has shown favoritism to Trump since the outset. This is hardly a shocking notion that she may be using procedural tools to gum up the works and help Trump attain a favorable outcome.

As to whether Judge Cannon could be appointed to the Supreme Court, I don’t even want to think about something that bizarre. This is a woman who caused a mistrial because she didn’t provide two boxes on a jury sheet, yes and no. Let’s just not put it out of the realm of possibility. Anything can happen in this Dali-esque political landscape.

  1. When I wrote about this I thought IF there’s a trial she’d word her jury instructions in such a way as to give at least one juror enough “reasonable doubt” to hang a jury. Or worse enough of them that in the end there’d be an outright acquittal. Judges can sometimes cause either a guilty or not guilty verdict via the way they instruct the jurors on the law. Opposing sides fight this out in front of judges every single day all over the country. I have to admit I didn’t even think of the horrifying possibility you’ve raised.

However, I still think she has no intention of allowing this trial to happen prior to the election, hoping Trump wins and a new AG makes the case go away. IF however Trump loses and there is a trial what you’ve proposed is a real possibility. It would be grounds for impeachment but it would take fifteen or more GOP Senators to convict and I don’t see that happening. Add to that, proceedings with John Eastman, Sydney Powell and Rudy notwithstanding lawyers are loathe to discipline, at least publicly other lawyers. And since she’s in FL I sure as hell can’t see the Bar in that state sanctioning her. She could actually get away with a stunt like this even if Trump loses in November!

Makes me sick inside we’re even talking about this.

  2. Your “… I have faith in Jack Smith. I think whatever curve ball is thrown his way, he’ll know how to field it and what to do. And let’s face it, Aileen Cannon …” by extension, could be plotting a situation where Jack Smith finds himself ‘winning battle, but losing the war’. Hopefully Jack Smith has an effective antidote to that, in the event it materialises.

    • I feel like she is pushing Jack Smith to go for broke and try to get her removed. Also, I feel that it is past time for Garland to purge the FBI and DOJ of all insurrectionist.
