This is a wild legal ploy but we live in a day and age where federal judges upholding the black letter law are depicted as politicized radical thugs and not just as jurists doing their jobs. We have Legal Barbie, Pam Bondi, as attorney general. She’s in the post because she was the lesser of two evils choice when put side by side with Matt Gaetz, not because she’s a legal talent of substance. Bondi has had no trouble calling those who vandalize Tesla cars “domestic terrorists” because evidently Elon Musk is now the state and this is like during the French revolution, “L’etat, c’est moi.” (I am the state.) So if you torch a Tesla, you’re torching the government, by this *logic.*
That would be plenty weird enough, since Musk isn’t even an elected official, but going that one stranger still, is the Department Of Justice’s request today to remove Donald Trump’s name as defendant in the January 6 cases and substitute the United States as defendant. What that means is that the Department of Justice would be suing the country, or itself in essence. Does that make any sense to you? Well, if not, that’s because you haven’t gone far enough down the rabbit hole to where Orwell meets Wonderland and it’s off with the rule of law’s head.
The Department of Justice (DOJ) told a federal judge Thursday that the United States should take President Donald Trump’s place as the defendant in several civil lawsuits seeking to hold him accountable for his supporters’ Jan. 6 assault on the U.S. Capitol.
If successful, the substitution could shield Trump from facing judgement in lawsuits brought by police officers and lawmakers who argue that his actions contributed to the harm they suffered in the Capitol attack.
The unusual move comes amid the Trump administration’s larger effort to erode the DOJ’s long-established independence from the president to advance his political and personal interests.
For the substitution to occur, DOJ officials must convince Judge Amit Mehta, who is overseeing the lawsuits, of their argument that the U.S. must be the defendant because Trump was acting in his official capacity as president Jan. 6.
The DOJ’s argument rests on federal law and Supreme Court precedent that prevents personal civil lawsuits against federal officials acting within the scope of their office or employment.
Mehta, who was appointed by former President Barack Obama, previously allowed the civil lawsuits to go forward by denying the argument that Trump was acting in his official capacity Jan. 6.
A federal appeals court later largely agreed with Mehta though said additional fact-finding should take place to determine exactly if certain actions were done by Trump the president or Trump the re-election candidate.
How was Trump acting in his official capacity as president when he incited a mob to riot and threaten his vice president’s life? Hey, we’re going to find out. And it will be straight out of Orwell. Trump was acting on January 6 as the spoiled brat child whose favorite toys were getting taken away from him, in this case his playhouse and his favorite game, which is “that dump” (as he’s called it) the White House and cosplaying president.
So Trump cobbled together a fantasy that the election was stolen and his right-wing propaganda machine went at it and many people poured into Washington, D.C. that day. You know all the details, the deaths, the suicides, the maiming, the Capitol police officers who were rendered disabled. It was a dark and ugly day in our history.
And Trump is now going to have his Justice Department prove that this was all “official” and “acting within the course and scope of his duties” as president, in his last three weeks of office, and not the lashing out of a spoiled child who simply could not accept defeat with any grace or dignity.
I cringe thinking what these legal pleadings are going to look like. I have an image of every lawyer involved taking out his or her diploma from the glass and setting fire to it, as Trump sets fire to the rule of law.
