Next For Trumpty: The Presentencing Interview Where He’ll Be Quizzed On His Mental Health

The man with the golden toilet, the one who complained that the climate control in the Manhattan courtroom was not set to his liking, is going to find himself in a real world of hurt when he has to go to the 10th floor of the Manhattan courthouse where he was convicted today, where he may now face “other conditions he may consider insulting, including a required inmate review by the New York City Department of Probation.” Washington Post:

The probation office on the 10th floor of the Manhattan Criminal Courthouse prepares presentencing reports for judges. There, Trump would be interviewed about his personal history, his mental health and the circumstances that led to his conviction.

Lawyers say the process is humbling.

“If you think the courtroom is dingy, just wait until you go to the probation office,” said Daniel Horwitz, a white-collar criminal defense attorney in New York and former prosecutor in the Manhattan district attorney’s office.

The routine processing of felons into the New York criminal justice system would include the timeline of a potential appeal. But with Trump, there would also be extraordinary considerations — such as how the Secret Service would protect the former president if he were sent to prison and whether he would be allowed to travel to campaign events if sentenced to home confinement.

Legal experts said incarceration appears unlikely for Trump, 77, who has no criminal record.

The Class E felony charges are punishable by 16 months to four years in prison. Among the key issues to be determined would be whether Trump faces some form of incarceration, either in a government facility or a private location, or a less-restrictive experience through probation.

New York Mayor Eric Adams said this month that the city’s Rikers Island jail complex and Department of Corrections were prepared if Trump were ordered to serve time.

This is good to know. And just hypothetically, if Trump was ordered to serve time and if he was elected, would cabinet meetings take place in the slammer? Would Melania live in an adjacent cell, or would she live in the White House, since she would be the First Lady?

Melania never showed up at all to the trial, not even for the sentencing, nor Ivanka. These are the most important women in Trump’s life, supposedly, his wife, and his beloved older daughter, who is his favorite child. Even his younger daughter and his two older sons showed up, but not Ivanka, and not Melania. Nor Barron. Whether that’s Barron’s wish or whether that’s how Melania told him it would go down, of course we do not know. That makes a statement. What it tells me, at least with respect to Ivanka and Melania is that they didn’t want to soil themselves with the proceedings or participate in the circus. Melania is a WINO, wife in name only, and evidently she’s set her terms as such. If she wanted to be there, she would have been there.

And I can’t say I blame her. Personally, I’ve only been involved in civil trials and not many of those. I know nothing of what being in a criminal court is like, other than from talking with people who did criminal law at the time. When people’s crimes are being adjudicated it’s different from a dispute over a breach of contract or a fender bender or some such. I remember a lawyer friend of mine telling me once, “There are two criminal justice systems in America, one for the rich and one for the poor. Don’t ever let anyone tell you otherwise.” I have never doubted for a minute that the man was right.

So Trump has gotten the benefit of the criminal system for the rich, but at some point, that disparity cuts off and a convicted felon is a convicted felon. And he’s going to have to go through this court routine, just like he did with the mugshot and fingerprinting and all that.

Trump will meet with the probation people and a presentencing report will be done. And he can scream “rigged” and “witch hunt” all he wants but I suggest he not do it when they’re discussing his mental health. Although that might make quite the picture, in and of itself.

  1. One imagines he’ll bring his elephant and giraffe drawings that prove his acuity. At Rikers he has three good options. A cell with his hold out, Allan Weisselberg, Michael’s Cohen’s old cell or the Epstein Cell. Plus he’ll be able to sing like a bird with his beloved J6 Choir. Such joyous reunions.

Took a while, but lady karma has finally and legally delivered:He has reaped what he has sown… and how devastatingly humbling that must be to a disenfranchised, delusional, ketchup tossing, micro managing, childish, revengeful control freak.

  4. If the interviewer recommends psychiatric evaluation, would Judge Merchan have the authority to remand him to a mental facility for an indefinite period? He’s a threat, both to himself and society at large. As much as I loath this man, I think he is mentally ill and should be institutionalized.

I’ve worked in the mental health field all my life, but I don’t know how they evaluate someone like tRump who not only won’t cooperate with any kind of mental “health” or mental “illness” assessment, but could very likely devolve into a complete psychotic, chair-throwing (no ketchup bottles in a psychiatrist’s office) meltdown! Maybe that would be the “evaluation.” Do the probation people have the authority to recommend to the judge that this man be remanded to an institution for the criminally insane for further evaluation and hopefully admission to said facility? The Secret Service could sit on metal chairs at a metal table and play pinochle while they keep one eye on Nurse Rachet and the other on the Orange Baboon straining against his straight jacket. Oh, what a BEAUTIFUL scene! 😛

  5. Give him a new MOCA exam, and publish the real results this time, as well as other psychological tests. Also publish his actual height without shoes, and his weight, though I think he has been taking medication lately to lose weight in anticipation of the prison weighing him.

If, indeed, the DON -the – CON IS called mentally deficient, his run for president and standing as the GOP GOD, he feels like, is gone forever … being sent to a mental treatment center is NOT SO BAD … He would get regular meals, a warm room in the winter, which he could see through two hurricane fences, with razor wire coils on top … Summer would bring on the air conditioning …

    His condition requires a great deal of red faced statements of his own importance and how unfair he is being treated, all due to a long list of, “Enemies”, for his own safety and relief to his handlers, they all will have permission to use a small syringe of sedation that will keep him quiet for several hours, I don’t think Donald will appreciate the total lack of privacy he would encounter, strong willed and smart women would TELL HIM what was going to be his next move, of course, there is always a supply of men, to help them out if he starts swinging … He would be up against men the size of a prize fighter that does not mess around with a whiner …

    As an alternative, I think Trump, in an ankle strap monitor, confined to Trump Tower for two years, without outside exposure, nor access to his cell phone, would reduce Trump to a bowl of Dung …

    The SS team could monitor him on several cameras, without having to bear his awful odors …
    The SS team could easily man handle him into a security van for visits to other trials, where any punishment would be extensions of his original assignment to the mental institution or Trump Tower …

    If, and when the government comes for his tower building they, could transfer him to a secure mental confinement building for the criminally insane …

    There he could get the help he needs …
    Non of the above fixes would settle for Trump, his reaction could be an all-out freak-out, and an implosion, heard for miles around …

  8. The justice system is a sham given it’s propaganda touts equal treatment, but in practice, the rich have no idea how it treats those of us without money. Trump cries injustice but he has no goddamn perspective or experience to teach him otherwise. That being said, given his 34 felony convictions, he WILL get a taste of justice that can’t be bought off or litigated until it goes away. Sometimes we have to be content with small victories that keep the ideals alive. This is that time. Remember he’s not been adjudicated in his other indictments, and going into them as a CONVICTED FELON, will not be good for him. Count on it.

It won’t, but the mental health report should say, “Defendant illustrates psychopathic, sociopathic, and delusional tendencies, including manifesting predatory and malignant narcissistic behavior with no remorse. He has difficulty telling right from wrong. Recommend lengthy prison term with ongoing psychiatric treatment. Lithium and ECT are indicated.”
