A crooked judge is a terrible thing. When you can’t trust the judiciary, you have no safeguard to the rule of law and when that basic guard rail is gone, then goodbye democracy. I am put in mind of the 1961 movie Judgment At Nuremberg, with Spencer Tracy and Burt Lancaster. Tracy plays a prosecutor and Lancaster plays a crooked judge in Nazi Germany. Lancaster respects Tracy and at the end he has a man to man talk with him. “You must believe me, we never thought things would get where they did.” Tracy looks him in the eye and says, “Things got there the first time you sentenced a man guilty whom you knew to be innocent.” A look of astonishment comes over Lancaster’s face as he realizes the truth of Tracy’s words.
Is Judge Aileen Cannon about to do something similar, let a guilty man walk, in the face of a mountain of evidence against him? That is what people are discussing. Cannon has set a day of oral argument to hear two motions Thursday. The arguments Cannon will hear relate to the claim that the Presidential Records Act allowed Trump to keep documents after he left office as they were his personal property. Good luck proving that. Trump’s legal team will also argue that charges Trump faces under the Espionage Act are “unconstitutionally vague” when applied to the former president.
As the lawyer just said, it’s a “very remote possibility” that a replacement judge for Cannon will be sought. So that gets to the heart of the matter here, what has everybody so concerned, is whether Cannon is seeking to have the classified documents case dismissed?
The initial trial date was set for May 20. Whether this case will go forward then is anybody’s guess. But after Employee 5, Brian Butler, came forward a few days ago and testified about moving the boxes from Mar-a-Lago and onto Trump’s plane, everybody’s appetite for more details of Trump’s mishandling of documents has been whetted.
Smith’s team is trying to get the case set for July and Trump’s lawyers also suggested a potential August start date, as required by a court order. Maybe Cannon is seeking to dismiss this case before it goes to an August trial. When all the evidence comes out about how crooked Trump is, right before election, it will finish him. Maybe today is Cannon’s last ditch effort to forestall that.
That is what is known at this hour before the hearing starts.
The small-brained, ignorant twit needs to be removed from this case NOW. She has proved she is not capable of acting like a judge on this case. I wonder if she is capable of judging ANY case.
Replacing Cannon would ONLY serve to delay the case even more.
Can the AG Garland intercede to disqualify Cannon if she goes rogue?
