Is anyone amazed? Faced with a ticking egg timer, and a November 12th drop dead date, a Trump lawyer from Virginia that nobody outside of divorce court has ever heard of before, filed a lawsuit today in federal district court in Washington DC today, naming both the January 6th committee as well as the National Archives as defendants, in a last ditch effort to stop the Archives from turning Trump’s presidential papers over to the committee.

I’m not a lawyer, nor do I pretend to be one, but even to me the filing looked like something you serve to the dog for breakfast. It states that the congress has no inherent investigative mandate, even though that duty is enshrined in the constitution, but went on to slyly claim that at the moment Trump took office, his every bloody word was max security classified, and therefor covered by executive privilege. Cow flop.

What Trump is up to is both apparent, and actually old hat. Trump spent 4 years obstructing first the Mueller probe, and then House investigations by claiming executive privileges’, and ordering aides and staff to ignore subpoenas, knowing that a compliant Tubby the Ewok would take no action. The object was always to run out the clock. And it worked. So it’s little wonder that Trump is getting the band back together for one last reunion tour. But because Trump lives in a world somewhere between Narnia and Thunderdome, he is blissfully ignorant that two very important factors have changed.

The first is the DOJ. As President, Trump used the DOJ to defend him, and to stall cases from going through the courts with every delay possible. But now Trump and his cronies are the defendants, and the Garland DOJ is unlikely to assist them by slow walking the process. And his lawyers are costing Trump actual cash money.

But the second, and more important matrix that has changed is the US courts. They are pissed off. They are all too well with Trump’s antics and tactics, and they are mickle displeased. After the election, Trump’s legal team filed 61 separate lawsuits in various state and federal courts, and went 0-61. As Jon Stewart always preached, They smelled bullshit, so they called bullshit. Not a single suit got past the initial hearing. More importantly, the federal bench, especially in Washington DC , are showing their displeasure with the lenience being shown to the Capitol Hill traitors. They are going into sentencing hearings where the DOJ has a plea agreement in hand, and overruling the DOJ and sentencing the miscreants to jail time. And they’re rather vocal in their rulings about why they did it.

Trump’s filing in federal court in DC today was nothing more than theater. The drop dead date for the National Archives to turn over the requested documents. All Trump’s lawyer did today was to file a suit with the court. The court now has to process the suit, and assign the case to a judge, who will have to assign a hearing date on his docket. All of which takes time, which is time that Trump doesn’t have. If the committee gets the documents, it’s game over.

The next step is critical. Trump’s lawyer is going to have to find a district federal court judge, and request a hearing for an emergency stay to jeep the National Archives from turning over the documents on November 12th. If he finds a judge, then a hearing date will be scheduled. And it’s the whole ballgame.

The federal courts, and especially the DC federal courts, who oversaw trials of Trump cronies that were interfered with by the DOJ are pissed. If Trump can find a judge to grant the emergency stay, then the entire process will bog down into an endless morass that will take 12-18 months to resolve. But if the judge refuses to issue the emergency stay, then it is almost impossible for the Trump legal team to get a hearing before an appellate judge before November 12th. It’s that simple.

As a businessman, Trump used the legal system, or the threat of it to threaten to bankrupt vendors and providers with bankruptcy through the legal system. As President, he used a compliant DOJ to run out the clock on investigations. Many years ago, singer Paul Simon wrote a song that nails Trump to a tee. It was called One Trick Pony. And the past is about to catch up with him. Don’t touch that dial.

  1. I never heard One Trick Pony by Paul Simon so I just listened to a recording of it. It DOES fit tRump to a T, except he can’t sing or dance. But he does represent a certain part of a horse’s anatomy.
