I’ll make this brief. Ask yourself a simple question. If you need open heart surgery, who would you rather have? A cardiac surgeon who graduated at the top of his class from the Harvard School of Medicine, or a general surgeon who graduated from the Argo School of Medicine And Tool And Die Repair?

This whole Trump prosecution has been a media circus from the start. Since unlike the BARR Department of Justice, the Garland DOJ doesn’t hold press conferences to smear innocent Americans, we are left with what Garland gives us. This department speaks through its court filings.

But true to his word, the court filings from the Garland DOJ have been a literal goldmine of information. Garland and Smith are literally educating the American public about the case with every brief. Normally court filings are short and dry affairs, meant to show the court nothing but the bare bones necessary to make their point. The Smith court filings are rich in detail, including in some cases photographs from the investigation. The DOJ is literally laying out their case for the public before they ever even step in court before a jury.

Which brings us to the main event. As a two time jury foreman I can tell you firsthand that trials, whether criminal or civil are chock-a-block full of stuff. There is testimony, evidence, displays, forensics, expert testimony, and so on. And in the end, it’s up to the jury to whack through all of the weeds and find the golden kernel of truth underneath it.

And to my mind, with my personal experience, it means that after all the sturm und drang, and after all of the court panoply, it all boils down to one thing. The lawyers. After all, it’s the lawyers who make the opening statements, question the witnesses, introduce the evidence, cross examine opponent witnesses to impeach their testimony, and make the closing arguments to the jury, the last words the jury will hear before they retire to deliberate a verdict. In the end it all comes down to the skill and believability of the lawyers.

And when you look at it in that prism, Traitor should get ready to spend the rest of his miserable, misbegotten life in federal prison. Just look at the recent history

  • Trump settled the Trump U case out of court for millions of dollars
  • Trump lost his Trump charitable Foundation through New York state civil fraud charges
  • Trump’s own company was found civilly to be a corrupt business organization in New York state court
  • Trump’s hand picked attorney, Joe Tacopenis tried hammering a quiet, demure, sympathetic plaintiff, write E Jean Carroll to a $5 million judgement against his client

Folks, this is not a superstar lineup of legal talent. And he has nobody but himself to blame. A notorious deadbeat dad when it comes to paying his lawyers when the rulings don’t go his way, no white shoe lawyers will touch Trump with fire tongs, and the ones who will won’t settle for a retainer, they’re holding him up for months of billable hours in advance.

And it’s showing. Trump’s lawyers went judge shopping in southern Florida, and found a Trump appointed judge that most legal experts agreed had no province to even hear the case. She sided with Trump on the issue of a special master for the Mar-A-Lago documents case, and what happens next? Smith’s lawyers shredded her not once, but twice before the 11th Circuit Court of Appeals. Not once, but twice! Putting her on official judicial notice for the documents case she’s overseeing now.

The Trump lawyers are outgunned, outmanned, out educated, and outsmarted. The trump team recently put a motion before the court to delay Trump’s documents case until after the election. Smith’s team thoroughly shredded it in 10 scathing pages. While judge Aileen Cannon has discretion, she knows she has the 11th Appellate Court looking over her shoulder.

This isn’t even a fair fight. Jack Smith is calling in the B-52’s, and the Trump team is flying around in a bunch of Cessna’s. All you need to look at for confirmation is the mid to high level J6 conspiracy defendants that have been brough to trial like Elmer Stuart Rhoades and Enrique Tario. They had paid attorneys better than what Trump has, and the DOJ lawyers have chewed them up and spit them out.

Sooner or later the Trump defense team is going to run out of hearings, delays, and continuances. And then it’s going to be time to put up or shut up. And when the DOJ team of lawyers gets them into a federal courtroom, they’re going to wish that they had gone into HVAC instead.

  2. It’s the lawyers – as in Trump’s are outgunned. No matter what they come up with (or Trump demands they try) a lawyer on Jack Smith’s team will shoot it down. Kind of like playing poker where one side only gets to use the regulation cards in the deck, but their opponent gets to draw from a separate deck consisting of wild cards anytime they want. At least that’s the way I see it.

    • I don’t recall seeing you here before, but Murf as a really severe glaucoma problem and often doesn’t have someone handy to proof his articles. Sometimes, but unfortunately not always one of us on PZ that has admin privileges can go in and do it & correct typos. Alas, as the main moderator it’s tough under the best of circumstances to edit in a timely manner. I live in the eastern time zone and Murf lives in Vega which is three hours behind. A lot of the time I’m in the rack trying to get some sleep when his posts go up. And not always able the next morning (my work for PZ started out doing 15-20 hours a week volunteering part time and even now I’m part-time – this is a small site) to go into articles and look for typos. So please cut Murf some slack. Most regulars here know the situation with his eyesight.

      • READ what Denis actually said. Regulars here know that Murf has eyesight problems and, like most of us, isn’t a touch typist, so we simply don’t make a fuss over typos. They HAPPEN (even to the best of us)

        • Also it has been noted that as long as the first letter and the last letter are in place the brain knows what it is. So I just go with the flow and I love Murf’s style of writing 🙂

          • You’re correct of course. What’s mind blowing is that NOTHING you or anyone has ever seen has been the image you see. At the back of the eye is the retina, with all those nerve endings that lead to the brain. In truth, this and every single thing you’ve seen in your life has been a “picture” with a fuzzy black hole in the middle of it! No rods and cones that determine what is is you’re seeing and what color or how bright/dark it is. What happens is that your brain extrapolates what’s in that “hole” and you “see a complete image!

          • Sometimes the typos are apposite and other times they are opposite.

            For instance, Typing ‘Trump is inane’ is just as good as typing that he’s insane.

            I do, however, reserve the right to comment if a typo is hilarious (heck – we all need a laugh now and again).

            Oh and I do read and write fluent Typonese

  4. Typos. With education being attacked and newsrooms gutted (editors and the fellers that do the qa/qc…), and social media, things have not been going well. ie. Getting used to it. Par for course. I can sweat and avoid getting all worked about little mistakes or even errors IF the main point or message gets through or (thru 🤔🤔). Heck sometimes I didn’t mind getting flagged at dkos when I vented about Garland. Sometimes the marquis de queens berry (now I got to goggle 😂) needs to mind his own bizness when some elbows and knees are accidentally thrown. Just saying.

    • Well as for typos – the father of Oscar Wilde’s boyfriend was the Marquess OF Queensbury (not ‘de’ because he was English and not French).
