Some hours ago I was doing a couple of things at once, one of which was monitoring the news on TV when I heard something that caused a WWTF? reaction. Like I said I was in the middle of something else and assumed I’d heard it wrong. But a while ago I checked online and sure enough the next court hearing in NYC for the charges filed today isn’t until December 4! Again I say WTF?
SEVEN f*#%ing MONTHS?
I’m not a lawyer. But hell, we’ve known all along the general sense of what this case would be, and don’t forget Trump had lawyers working on his behalf on the same issues back when he was “Individual One” and for the time being at least couldn’t be charged. But much of the evidence has been out in the public domain for ages. Also, even if he really had deluded himself Bragg wouldn’t pull the trigger on charging him until it was time to get in the car, that no phone call came saying “It’s over – Bragg backed down” part of him knew it was possible. That the stuff his lawyers, even though they are mostly second raters were telling him would come to pass. And they’ve been doing through all the work product of the lawyers who worked for Trump when SDNY was on the case and working their own leads and conferring with people who’d talked to the grand jury were willing to tell them.
So I’m gobsmacked the judge has allowed so much time for them to review the charges and file motions. By NY law the prosecution is granted an equal amount of time to respond to whatever the defense files with the court. The upshot is that this back and forth is going to take SEVEN effing months! Give Me A Break. Yes, there are 34 counts in the indictment but there are “repeats.” It would seem there are also multiple means DA Bragg has laid out to shift the charges from Misdemeanors to Felonies. So I get that the stock 4r days to respond to the indictment (and file motions) and 45 more days for prosecutors to respond and file their own motions might be ext4ended some. I heard as much from legal pundits in the leadup to Trump actually finally heading into the courtroom. As a result I figured it would wind up being late summer (probably) before the judge had everyone back for a status hearing.
Also, this judge has already dealt with trump/the Trump Org. and he damn well knows that delay, delay and then delay some more is standard practice. He really, REALLY should have known better than to do what he did and it seems buy into Trump (well, his lawyers) bullshit about how they needed sooooooo much time. Say until just before the earth is consumed by the sun billions of years from now. Maybe that might be enough.
I’m shocked. Disgusted. And thinking thoughts that as retired humorist Dave Barry would include “extremely very bad words.”
Contrast all this with what has been going on in the federal judiciary. Back when federal judge and Trump fluffer judge “Loose” Cannon started running interference for Trump people were amazed at how quickly her rulings were slapped down (hard) when the govt. appealed. Even though it took weeks it was, for the federal court system what was then considered amazingly fast. And let’s face it, absent a death penalty matter right before an execution or something that’s a true emergency that affects the whole country Federal courts including and especially appellate courts are famous for taking their sweet-ass time. Like rich and powerful people at exclusive clubs (It’s Masters Week so Augusta National and the years long flap over having women members comes to mind) they have a “I/We will deal with this when I/We are damned good and ready and the more pressure you try to bring the longer I/We will sit on it!”
However, starting with how they (and the appeals court that slapped her down was a conservative one!) something changed. Federal judges at least have grown increasingly tired of Trump’s antics and don’t want his crap cluttering up their dockets. Maybe the paperwork carries an actual Trumpian stench they don’t want permeating their chambers and courtrooms. Whatever it is, they are treating Trump appeals with dispatch, and that recent one where within a day or so of it being filed Trump’s lawyers were giving until midnight to explain themselves to the court on various points and the govt. lawyers had to pull an all-nighter to have their response in by 6am it was clear there’s new sheriffs in town and before the pundits could slice and dice everything the order telling Trump to bugger off was issued!
Federal judges, even conservative ones at the appeals level at least are done with Trump’s delaying tactics. Hell, it’s not like Trump legal filings are complex, with tons of legal nuance and references & precedent to sift through. They read the crap, make notes which it’s safe to say WHY they are crap, read the govts. response which is cogent and to the point and write up an opinion. Telling Trump to go pound sand.
In fact, earlier today in yet another attempt to invoke Executive Privilege to keep Pence and a few others out of Jack Smith’s grand jury room it was if I’m not mistaken mere days since the appeal was filed and the DC Circuit denied it. Should Trump request an En Banc (the full appeals court) to hear the matter I’m willing to bet it will be scheduled within days of the request being filed and in a couple more days Trump will again be told to STFU – and Pence and the others ordered to get their butts into the grand jury. Trump has been down this road enough times to know that SCOTUS wants nothing to do with it all.
So, I’m back to wondering why the hell the judge in NY isn’t going to have everyone back to argue motions and set a trail date until seven freaking months from now. Perhaps an actual lawyer (Jason? A little help?0 might be able to tell me why I’m a tad off base. Or not even in the ballpark.
Oh, I’ve got one last thought regarding the speed with which federal judges/courts are now handling Trump stuff. Like many I’m frustrated at hell at DOJ’s pace. I’ve defended Garland in part as he had an entire DOJ to rebuild. At the same time I’ve criticized him for, instead of naming a Special Counsel to deal with Trump stuff trying to do everything including overseeing Trump related matters, especially since with a then hollowed out (not that it’s completely rebuilt even now) agency conducting the January 6 insurrection. The largest (by far) case the DOJ has ever faced. However, Smith didn’t seem to take all that long to get up to speed, and there ARE two tracks to his work. J6 and the classified documents.
Since I have some experience with classified documents including taking part in securing and handing in improperly secured ones I actually know shit about hos this goes for the typical person. (Not well in case you’re wondering, and consequences start the day the matter is reported to the powers-that-be) Yes, high enough ranking assholes get some, I emphasize some slack but with the number and type of documents Trump took, and the over 100 he tried to hang on to after he’d been subpoenad and attested (via h is lowers) everything had been turned in Smith has had him dead to rights from the day he was put on the case. There’s testimony. There’s video. There’s documents about negotiations and Trump’s bullshit claims. There are apparently at least some down in FL who’d rolled on him. What the hell else does Smith need? Sure, he just found yet another piece of evidence we are told, but there will be new stuff about this coming out not just for months but for years. At some point it’s time to proverbially take the field and play the damned game!
However, the one thing I didn’t consider until I was well along writing this is that speed with which federal judges/courts are moving when Trump matters come before them. When Smith walks into court to present an Indictment, even on something as straightforward as the documents case he’d better be ready to proceed right then and there. There won’t be months Iat least nowhere near SEVEN) for Trump’s lawyers to respond to the charges and prosecutors to rebut. Nope. Once Smith takes this to court he’d better be ready to proceed at a fairly brisk pace. I get that he’s been gifted by Trump the ability to sidestep tricky issues as to presenting fully unredacted or minimally redacted classified documents in court and has been reworking his case (probably) on that basis.
But it’s time. Frankly, if Smith moves on this soon we might well see a federal trial of Trump underway while they’re still dicking around up in NYC!
Smith is suppose to be one of the best, so I’m counting on him .
Fat ass will be tried for state crimes while under federal custody.
The feds will be locking him up soon.

I get he feeling that the actual trial date is being held off, and the New York indictments ae just an appetizer, which will give way to the bigger fish. Ergo, no gag order, to let Trump continue to convict himself, much as he did last night. Let’s watch and see. There seems to be a bit of method to all this madness.
It may be that the 7 month pause gives one of the other cases a window to start—-and make its own impact on the country/in the media. Shoot, the jurisdictions may have coordinated their calendars to “cascade” trials. Good idea, IMO!
only seven months? I mean, c’mon dude. NYC courts have got to be packed to the gills. I’m thinking seven months isn’t so bad. It isn’t as if the courts can bump other people out further can they?
Patience, Grasshopper. Maybe the judge is just giving Fanni Willis and Jack Smith a chance to enter the fray. And NYC courts are probably already backlogged. Factor in the ultra-cautious approach of all three prosecutors not wanting to give anything away on appeal. I’m hopeful that this is finally the beginning of the end for the man. That MAGA movement, not so much.
Well I’m an old country boy but what I see is that Jack Smith was born ready and walks around with a briefcase full of enough paperwork to slap it on his table and say the prosecution is ready your honor. That’s why he’s there. Right now he’s just playing the game. It’s like when your fishing and you know you got the big one but you don’t want to make it look to easy to your friends. And that is my feeling on this whole thing. Jack Smith wasn’t in a cave. He knows what Trump was doing. Now like I said, I might be some dumb old country boy with a fantasy. Or I might have the inside straight on a million dollar game. Look what Bragg and the judge already did to trump. He already had a whole campaign setup for his mugshot and his arraignment. It was gonna make PRBarnum look like an idiot. He was going to crucify the New York judiciary system. Well guess what. Allan Bragg told trump in polite terms to go fck himself. Just like that. Trump campaign just got fcked. And as an added delight the people of New York got to tell Marg Greene to go fck herself and take her fat ass back to Georgia where it belongs. And to be fair. I watched the footage of her leaving and many people were waving and indicating that she was number one. Although I don’t think that they were holding up the right finger. But you got to give them an A for trying.

Countless times he’s fucked over business partners, banks that have lent him money (which is why legitimate U.S. and almost all foreign ones STOPPED lending him money) and fucked over contractors who’ve done work at is properties including to the point of costing some their entire business and putting all their employees out of work. He’s cheated his own relatives regarding his father’s estate. He’s gone extaordinary lengths to hide where he has gotten loans from, because both of his own sons admitted years ago when asked why the Trump Org. wasn’t able to do business with banks that had once lent to him said they got all the money they needed out of Russia. There’s ample evidence he has laundered money for U.S. and foreign organized crime (one business nailed for money laundering was housed in Trump Tower!) He has fucked around all all three trophy wives and even (as was noted in court proceedings during his divorce from his first wife) raped one of them. And he has a long history of other sexual assaults and sleazy behavior – bragging about being able to walk in on naked women in the dressing room at beauty pageants he owned for example. And his sick obsession with FUCKING his daughter, Wannabe Princess Ivanka. Also with more than one instance of his bragging about it on fucking camera. As President he shredded customs and norms and even broke laws knowing even if impeached McConnell would never allow enough Republicans to join in voting to convict him in the Senate. He gave literaly aid and comfort to brutal dictators and emboldened them while at the same time trashing long time allies and alliances, causing the rest of the world to start re-thinking whether the United States of American could be relied up to honor its committments. He literally turned us into a laughinstock on the world stage – tried out his self-promoting schtick at the U.N General Assembly and the world’s leaders LITERALLY laughed in his ugly orange face! He sought and helped assistance from Putin to make it into the WH and even Putin acknowledges helping out. He tried to do so again in 2020. He incited an insurrection that resulted in deaths, lots of injuries and a tond of money in damage to the Capitol. And sat there at the WH cheering it on, puzzled that those around him didn’t agree with his saying “isn’t this great?” The whole world watched in horror as for the first time in our nation’s history a President not only tried to illegally hold on to power by violating a Constitutional process with violence but cheered it on. And still cheers what happened that awful day btw.

One of the great questions that troubles me should the unlikely come to pass and I was in Trump presence it he was on fire and the skin being burned from his body is whether, lacking water or some other means would piss on him. On the one hand I really, REALLY want to see him die in prison so doing all I can to put out the fire makes sense. On the other hand, with his skin burning and raw some of the stuff that makes up urine (again, that’s piss you dumbass!) would sear those nerve endings and take Trump’s pain and suffering to a whole new level! Not as much suffering as he deserves, but still something this ole jarhead would enjoy immensely.
