If you’re wondering why Donald Trump is so riled up over the New York fraud case and screaming to have it dismissed, this is the reason why. Ivanka Trump got subpoenaed last week to appear at trial as a fact witness and she’s pulling out all the stops to quash said subpoena. She’s claiming it’s overbroad, it wasn’t served properly, anything that she can think of because she doesn’t want to be put in the position of committing perjury, or alternatively, hanging her own father out to dry. But alas, those are her two choices, according to Joyce Vance on her Substack page.

Ivanka Trump, who had previously been dismissed from the ongoing civil fraud case in New York on statute of limitations grounds we’ve discussed, was subpoenaed as a witness late last week. Not surprisingly, she doesn’t want to testify and has filed a motion to quash the subpoena.

Ms. Trump claims that since New York Attorney General Letitia James didn’t depose her before trial, she’s not entitled to her testimony now. “Trial subpoenas are not a means for parties to get discovery, which they failed to obtain during pretrial proceedings,” Ivanka Trump’s attorney argued before adding, “[t]he NYAG, which never deposed Ms. Trump, is effectively trying to force her back into this case from which she was dismissed by a unanimous decision of the Appellate Division, First Department. Ms. Trump is not a party in this action. Nor is Ms. Trump a New York resident. It is black-letter law that, given those two facts, Ms. Trump is beyond the jurisdiction of this Court.”

But there has been testimony at trial about the valuation of Ivanka Trump’s penthouse in her father’s Trump Park Avenue property. No longer a defendant, she is nonetheless a fact witness in this regard, and it seems likely she’ll be ordered to testify. In 2011, Ivanka Trump signed a rental agreement with an option to buy a penthouse on her father’s property. The Attorney General says that although Ms. Trump has denied it, she benefitted from “insider” pricing—she had an option to buy the penthouse for $8.5 million, but the Trump Organization’s financial statements valued the unit at $20,820,000. Since this type of price manipulation falls within the core allegations in the lawsuit, James should be permitted to call Trump, pre-trial deposition or no.

Ivanka Trump may well have to choose between Daddy and perjury, which is why she’s fighting the subpoena. It shouldn’t be a tough call. If their positions were reversed, it’s hard to imagine Trump sacrificing himself for her. As the wheels come off the Trump’s legal wagon, it’s going to be everyone for themselves.

Trump is losing it imagining Ivanka on the witness stand, in essence hanging him, but that’s the likelihood of what her testimony will accomplish. She can either acknowledge the facts that Letitia James has discovered or she can sit up there and lie her ass off and risk perjury. I don’t think she’s going to do the latter. When she was asked whether Daddy won the 2020 election she said no. She didn’t lie for him then and I don’t see her lying for him now.

Ivanka has done everything to distance herself from the Trump Organization and leave her two brothers holding the bag. But she’s not likely to escape this so easily. This is going to be the January 6 Committee all over again. The end result of the New York fraud case is that the Trumps aren’t going to do business in New York State again.

Let me see if I’ve got this: Wannabe Princess Ivanka fought like hell to get herself removed from the case (using statute of limitations for any crimes she might have committed) and in the process therefore fought having to sit down with investigators. Much less be formally deposed. And now her argument is “I can’t be forced to testify because prosecutor’s never deposed me?”

    It’s a variation on the kid that kills both parents and then begs the court for mercy over being an orphan.

    Someone correct me if I’m wrong but people testify in trials including criminal ones every day that didn’t sit for formal depositions. In fact, in some cases certain witnesses get “star treatment” by NOT being deposed, or having interviews recorded by prosecutors precisely to avoid the other side being able to pin them down with even a tiny inconsistency during a cross-examination.

    However, from the way I understand this case she’s a fact witness to a specific matter. The prosecution already has records and other evidence. All she’s being asked to do from what I can tell is verify it. To say yes or no, this or that record and/or this or that testimony from others is accurate – or to deny it. She ain’t cut out for prison so she can be truthful and verify what James’ team has or lie and expose herself to a perjury prosecution. I for one don’t have an ounce of sympathy for her being in the position of choosing to cover her own butt or sell out daddy.

Finally, will you admit that Ivanka phucking over daddy, who wanted to phuck her, is closer to being ironic? I rest my case.

I predict & look forward to Ivanka writing a book about growing up with a bit too handsy & overly interested Dad from whom she suffered abuse & molestation. Eventually she will recognize the money making opportunity for this literary venture & will take advantage, probably after her father is either in prison or dead. I originally assumed she would wait until after his death, so as not to be written out of the Will… but after this NY fraud case, DON THE CON might not have much money or property to leave in a Will anyway.
