Keep an eye on this one, because it’s going to move fast. But two groups of lawyers have filed a suit in North Carolina, Cawthorn’s home state, the is ineligible to run for reelection. And if it works, it could not only cure us of insurrection nut Cawthorn, but other mental maladroits like Gohmert, Gosar, MTG, Matt Gaetz, and even Trump himself.

What the suit hinges on is Act 3 of the 14th Amendment, which was passed after the Civil war. The goal was to ensure it could never happen again by barring officials who backed or promoted an insurrection from future service.

Here’s the basics. The act bars any Senator, Representative, or other office holder, including the President, who swore an oath to the constitution, who then foments, aids, supports, abets or supports an insurrection, from holding or being elected to public office again. They disqualified themselves when they violated their oath to the constitution.

What makes North Carolina an interesting test case is that apparently they have state law stating that if credible allegations and evidence are presented, then it becomes Cawthorn’s responsibility to prove that he didn’t violate his oath, and is still qualified to run. Which, given his on record statements, is going to be problematic.

Another thing. As MSNBC legal analyst pointed out today, these aren’t the kinds of cases where they can pull a Trump and run out the clock. North Carolina will have a finalized ballot by the end of May, and Cawthorn either will or won’t be on it. Which means that the legal case will need to be settled by the GOP primary.

Look, I’m no lawyer, I don’t even pretend to be one in here. But having read, painfully, and heard the act read, it actually seems pretty cut and dry. If you swear an oath to the Constitution, and then turn around and cheer on a bunch of far right thugs trying to overthrow democracy, you can’t be trusted to take another oath. Your word is shit. Don’t touch that dial.

  1. It’s not just what he said but what he did, as in casting votes to deny the acceptance of properly cast and certified electoral votes. He can whine all he wants about fraud, but there is a long, LONG list of court decisions including up to the SCOTUS level saying those claims of voter fraud had no legal merit. This could get interesting, and not just for KKKawthorn.

    • Not if ur from AZ. The asshats used a goddamn state seal,(crime), on a fraudulent document SIGNED & sent to the senate & national archives. The secretary of state referred it to the fuckhead attorney General ONE YEAR AGO…crickets. Why? The asswipe is a Trumper & trying to get an endorsement to run for the senate. So to summarize: the AZ STATE ATTORNEY GENERAL IS A CRIMINAL SUPPORTING CRIMINAL ACTIVITY IN VIOLATION OF HIS OATH OF OFFICE. This fucking place is one goddamn bad acid trip with no end.
