That’s is rule number one of any person who is indicted or charged with a crime. Last time I checked we still had the 5th Amendment, made applicable to the states through the 14th Amendment, in that every person who is charged with a crime is innocent until proven guilty. Or do you find that a mere inconvenience? If so, perhaps you would prefer a change to the Constitution and its Amendments? So I’ll preface this by saying that I will be happy when he goes to prison for the rest of his life. But let’s look at this from a legal perspective. First, the plea is for trafficking. There’s no reason that he would plead guilty to this charge just because another potentially chargeable offense came up. The disc doesn’t prove the trafficking charge…although we presume it will be evidence in the case. An analogy might be finding ‘The Anarchists Cookbook’ in the home of a suspected bomb-maker. The disks may not prove trafficking – but they’re proof of possessing child pornography. Which he’ll likely be charged with.

Possibly…if they are pornography, which isn’t clear. The news reports say nude and partially nude women and girls, so that could be illegal materials or not.

But The NY Times just posted that prosecutors are using the find to demonstrate that he’s not reformed or repentant, and therefore should be denied bail. So the collection might rob him of the ability to flee, which seems like a huge risk. At this point, keeping him in custody seems like a primary objective.

If the girls are under the age of consent, it’s child pr0n. And since some of the disks have names, and they have testimony from the victims that they told him their actual ages – it’s genuinely child pr0n.
He’s genuinely a flight risk: he has money, he has both ground vehicles and jets, he has property in several places, and he has friends who might still be willing to risk their own freedom for him.

I’m sorry, nude photos of underage girls, UNDERAGE girls….possession of nude and/or partially nude photos of underage girls…is a crime.

In general, it is considered child pornography to possess or distribute nude pictures of a minor. Child pornography is a strict liability crime. That means you are guilty even if you didn’t know she was a minor or even if she lied to you. You expose yourself to the possibility of being labeled a pedophile and sex offender the rest of your life.
