Mike Lindell is dying to make a lot of things happen. First and foremost, he wants to get his phone back from the FBI. He says his hearing aides don’t work properly without it. I wonder if he really has hearing issues or if it’s just the voices in his head that are difficult to control, but I don’t expect an answer on that one any time soon.

But beyond even the phone, there’s this pesky matter of Dominion Voting Systems suing Lindell for $1.3 billion. Ouch. Dominion is not a True Believer, as Lindell is. Au contraire, the company is the actual victim of Lindell and cohorts, whereas he claims that they are victimizing him.

Lindell has tried to get the Dominion lawsuit dismissed and went so far as to have his lawyers appeal it to the highest court in the land. Result? Crickets. NBC News:

The justices’ decision not to hear the case means a federal judge’s ruling in August 2021 that allowed the lawsuit to move forward remains in place.

Mikey doesn’t like this federal judge, Carl Nichols. No, Sir, he does not. Nichols is a real pain in Lindell’s derriere.

Lindell had unsuccessfully asked U.S. District Judge Carl Nichols of Washington, D.C., to allow him to appeal two legal questions related to the landmark 1964 Supreme Court defamation ruling in New York Times v. Sullivan, which concluded that there must be evidence of “actual malice” for a public figure to pursue a defamation claim. Lindell argues that Dominion is a public figure because it performs a government function in elections and that therefore the “actual malice” standard applies. His lawyers argue that because Lindell genuinely believes in his claims, there was no “actual malice” and that therefore the lawsuit should be dismissed.

Dominion also sued Trump allies Sidney Powell and Rudy Giuliani for defamation. Nichols allowed those claims to move forward, as well, but Powell and Giuliani were not involved in Lindell’s Supreme Court appeal.

In a separate case, Nichols in May threw out Lindell’s own defamation lawsuit against Dominion and Smartmatic, another voting machine company. Dominion and Smartmatic have also filed similar defamation lawsuits against Fox News and other conservative media outlets.

What’s a pillow guy to do, huh? And this is even with two “pals” on the Supreme Court, what’s up with that? Clarence Thomas and Neil Gorsuch have previously suggested that, “the 1964 defamation precedent, which makes it harder for public figures to bring defamation claims, should be overturned.” Well, why don’t they overturn it already?

Somebody better do something fast, because Dominion is still on the warpath, Lindell is still on the hook, and things aren’t getting any easier. Or cheaper, that’s for damn sure.

It’s interesting how the SCOTUS didn’t see Lindell’s “true believer” argument as valid of judicial review. This is Lindell’s version of the insanity defense and the fact that it didn’t fly does not bode well.

The Big Lie may fry Lindell, like a packet of Hardee’s potatoes, and provide a template for how these things go in the future. Stay tuned.

    • No. Do NOT repost that PIECE OF LYING BS PROPAGANDA. You make a hell of lot of whiny-ass complaints about this site being “propaganda” but “2000 Mules” is nothing BUT propaganda–produced by a master of pushing propaganda (and one who has a FELONY CONVICTION on his record–Trump’s pardon of the sleazebag does NOT vacate the felony conviction since that is a completely different legal process).

      Dinesh D’Souza wouldn’t know the truth if it came up and knocked him over the head with an oak 2×4.

    • red, you and apparently the folks behind the “documentary” 2000 Mules, haven’t a clue just how much it costs to purposely cast ONE fraudulent ballot (BTW, I’m not talking about the occasional ballots we see getting cast by republicans who have lost their spouses but have not informed their county election officials of that fact). I’m referring to the systematically fraudulent ballots cast– what it costs to obtain a ballot from the county election official, everything that needs to be changed/created to get that ballot, etc. at a MINIMUM is $10,000. More to the point, D’Souza provides not one scintilla of evidence to back up his claims. Not one iota. No one has provided EVIDENCE, no one has provided FACTS, no one has provided anything other than that which is pulled from one’s ass as evidence ballots were falsely and with forethought cast for either candidate (again, other than those we’ve seen cast by republicans because of things like dead spouses, etc. and are so few they are meaningless).

      These claims of “fraud” have been subject to a great deal of ACTUAL analysis, audits, and many court trials/proceedings. The result? The “fraud” did not occur. Our country sets the GOLD STANDARD when it comes to elections. We SEND people to elections in countries needing oversight for their elections because of this-these people are requested by the countries BTW.

      You know something red, you cannot just spout things and expect people to say “ooooo, I didn’t think of that” or “hmm, maybe we need to look into this further because surely someone hasn’t thought of that”. You cannot just post a link and expect people to not look for things in it like whether the sources cited are credible or have they been discredited by factual information. D’Souza’s little video has been discredited by folks with these inconvenient things (to him) called facts (of which his video show exactly zero). We can peruse the video ourselves and many of us have done this if only to say “this video is factually deficient”.

      You act like the folks who read this blog have never viewed D’Souza’s video. Many of us have. News flash: many of us have and we found it repugnant or silly NOT because his views run counter to ours but because his video lacks a factual foundation. Put simply, he created a fictional video.

        • Do you understand how ballots work: every precinct has a DIFFERENT ballot. Now multiply all those ballots by the number of precincts in a state…or the country. This is why that movie is CRAP. (Besides talking about dropboxes in GA while using a map of Moscow).

        Hardly – you elect the officials in charge of the process on a partisan basis. That’s a major weakness. I’m sure, ATM, most are doing it honourably, and we know 1 or 2 have heroically held out under threats, but MAGA elements are reportedly trying to elect less scrupulous people to such posts. The fact that they are not appointed officials trained in impartiality, as presumably they are in most democratic countries, creates at least the appearance of potential bias, and can be an unnecessary tension for the elected officials when making sensitive decisions.

  2. Lindell’s lawyers ought to know that even if he “genuinely believes” his bullcrap, it does NOT automatically mean that it isn’t malicious in nature.
